Scientists try to expel space pioneer Elon Musk from the Royal Society after accusing him of 'disreputable' behaviour

Elon Musk could become the first member of Britain's top science club to be expelled in over 150 years after furious scientists initiated a crisis meeting over his 'disreputable' behaviour.
The world's richest man has been a Fellow of the Royal Society Scientific Institution since 2018 when he was awarded the honour in recognition for his work at ventures such as Tesla, SpaceX, Neuralink and the Boring Company.
However, the Royal Society is now set to meet next month to discuss the possibility of revoking Musk's membership after more than 2,700 scientists signed an open letter accusing the X owner of breaching the society's code of conduct.
The letter, penned by biologist Stephen Curry, cited Musk's apparent shift from scientific pursuits towards right-wing politics both in the US and abroad as the principal concern of other members.
Referencing Musk's perpetuation of conspiracy theories online, his trolling of Dr Anthony Fauci and his labelling of Labour MP Jess Phillips as a 'rape genocide apologist', Curry argued the South African billionaire had clearly breached the Royal Society's code of conduct.
Other issues of contention included Musk's involvement with the Donald Trump administration's new Department of Government Efficiency (DOGE) and its alleged impact on the science community.
In the open letter, Curry stated: 'The situation is rendered more serious because Mr Musk now occupies a position within a Trump administration in the USA that has over the past several weeks engaged in an assault on scientific research in the US that has fallen foul of federal courts'.
Confirming the scheduling of an emergency meeting, a Royal Society spokesperson told Fortune that a debate will take place on March 3 over 'principles around public pronouncements and behaviours of Fellows'.
This open letter is not the first voicing of unease with Musk's Royal Society Fellowship.
Last November, Professor Dorothy Bishop, a University of Oxford psychologist, resigned from the scientific institution.
Protesting Musk's behaviour and involvement in the 2024 US Presidential election, Prof. Bishop said she refused to be associated with a group that calls Musk a member.
At the time, Prof. Bishop remarked that Musk was modelling himself on a 'Bond villain'.
'I just feel far more comfortable to be dissociated from an institution that continues to honour this disreputable man,' she added.
Her resignation was followed by that of Andrew Miller, a University of Edinburgh biologist, last week.
Miller cited the society's 'inability to take proportionate action on Elon Musk's current promotion of disinformation and attacks on evidence-based policies and science advice' as cause for his resignation.
The Royal Society has previously boasted esteemed Fellows such as Albert Einstein, Isaac Newton and Charlers Darwin, with current celebrated members including Sir David Attenborough and Sir James Dyson.
Founded back in 1660, the Royal Society is the UK's oldest scientific academy.
The Royal Society has so far refrained from naming Musk as the Fellow whose membership they are meeting to discuss, instead stating that 'any issues raised in respect of individual Fellows are dealt with in strict confidence'.
If the scientific body were to follow through on other member's demands, Musk's removal could result in significant damage for the centuries-old society.
Any decision made is likely to be viewed as a political one, with the institution at risk of becoming embroiled in a public culture war, the likes of which have already subsumed many of Musk's recent critics.
One Fellow at the Royal Society spoke anonymously to The Times and expressed his support for Musk to hold on to his Fellowship despite his 'reprehensible behaviour'.
'I don't like what Musk is doing - it's reprehensible. But I also think he's an astounding person in terms of what he has contributed to engineering.
'The society would be hypocritical if it singled out and censured one person for things they have said and done. You open the doors to charges of hypocrisy if you go down this road', they argued.

US diplomats have revealed to media Washington's deep involvement in the war on Gaza, where tens of thousands of children have been killed.
US diplomats have revealed the prominent role Washington plays in the war on Gaza, from supplying the ammunition used in Israeli massacres to blocking details of Palestinian suffering in the besieged enclave.
A US diplomat based in the UAE with two decades of MENA experience, Hala Rharrit, told CBS News' 60 Minutes programme that she was effectively censored in the images and information she provided to the leadership in Washington about what was happening in Gaza.
Rharrit resigned from her position as Dubai Regional Media Hub's deputy director n April 2024 over her government's policy on the Gaza war, and after being told three months into the war that her reports were no longer needed.
"I would show the complicity that was indisputable. Fragments of US bombs next to massacres of.. mostly children. And that's the devastation. It's been overwhelmingly children," she told the broadcaster.
She was told she was effectively told to "shut up" when compiling the reports for the US government illustrating regional perceptions about Washington's role in the war on Gaza, made up of social media messages and Arabic-language articles. She also agreed that the Washinton's stance toward the Gaza war had "put a target on America's back".
"I would show images of children that were starved to death. In one incident, I was basically berated, 'Don't put that image in there. We don't wanna see it. We don't wanna see that the children are starving to death'," she added.
The scenes of children caused Rharrit to break down in tears, including one little girl, Aana al-Farra, whose death particularly affected her.
"One Pan-Arab channel one day did a report on a little girl that had been killed in an airstrike. But they put a picture of the little girl when she was alive," she said. "She has her princess dress, and she's in the picture waving her wand with a huge, beautiful smile. And, you know, I saw my child in that child.
Josh Paul, another leading State Department official who resigned due to the Gaza war, spoke about the prominent role Washington has played in keeping Israel armed, as Lancet reported last week that at least 70,000 Palestinians have been killed in Israel's onslaught on Gaza.
"Most of the bombs come from America. Most of the technology comes from America. And all of the fighter jets, all of Israel's fixed-wing fleet - comes from America," he told the broadcaster.
"There is a linkage between every single bomb that is dropped in Gaza and the US because every single bomb that is dropped is dropped from an American-made plane."
When asked if Israeli airstrikes on Gaza are 'made in America', he responded: "They are."
This included the destruction of a whole neighbourhood in Gaza City shortly after Hamas's 7 October attacks when 100 people were killed including 81 women and children, according to Airwars, with US-made 2,000 pound bombs used in the massacre, sources told CBS.
"The Israelis were using those bombs in some instances to target one or two individuals in densely packed areas. And in enough instances, we saw that was in question, how Israel was using it. And those weapons were suspended," Paul told CBS, referring to President Joe Biden's temporary freeze on 2,000 pound bombs going to Israel.
Andrew Miller, former deputy assistant secretary of state for Israeli-Palestinian affairs who also resigned during the Gaza war, also said Washington had failed to issue any red lights to the Israeli government over the use of American weaponry.

A former Interior Department communications director in the Biden administration has been hired in a new role and will be working on communications inside the Biden White House, despite sparking controversy last year over social media posts attacking police, criticizing Republicans and supporting the anti-Israel movement.
"After more than three years at Interior working for Secretary Deb Haaland,Cherry started last week as an associate communications director at the White House," Politico reported this week.
Tyler Cherry sparked controversy last year after social media posts surfaced in which he blasted law enforcement and promoted "Russiagate."
"Praying for #Baltimore, but praying even harder for an end to a capitalistic police state motivated by explicit and implicit racial biases," Cherry posted in 2015 amid riots that were sparked following the death of Freddie Gray, a Black man, in police custody in Baltimore.

"Apt (sic.) time to recall that the modern day police system is a direct evolution of slave patrols and lynch mobs," he stated in a separate post months later.
In 2018, Cherry called for Immigration and Customs Enforcement (ICE), the Homeland Security Department agency tasked with preventing cross-border crime and illegal immigration, to be abolished.
Cherry was also posting support for "Palestine" on social media in 2014 during the Gaza War in which Palestinian forces, led by the radical Iran-backed terrorist group Hamas, launched hundreds of rockets into Israel, sparking a forceful Israeli response that involved airstrikes and a ground invasion.
Cherry was appointed Interior Department spokesperson in 2021.

Cherry also has a history of criticizing Republicans on social media, including in 2017 when he said that conservatives in the Republican Party were focused on "white grievance politics."
"The Tea Party was never about the debt/deficit but about racism and white grievance politics," he wrote on X.

Judge Aileen Cannon is again ripping up the court schedule in former President Donald Trump's classified documents case - pushing some of the legal questions that have been before her for months even further down the road.
Cannon is planning on holding a sprawling hearing on Trump's request to declare Jack Smith's appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor's authority.
The planned hearing also adds a new, unusual twist in the federal criminal case against the former president:Cannon on Tuesday said that a variety of political partisans and constitutional scholars not otherwise involved with the case can join in the oral arguments later this month.
It's an extraordinary elevation of arguments in a criminal case - filed a year ago this week - that likely won't see trial until next year, if at all.
Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump's rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue.
Cannon willhear arguments on those issues the week of June 21, as well as on the effort by Trump to throw out evidence in his case that was gathered by the FBI in its 2022 search of Mar-a-Lago or provided by his former attorney Evan Corcoran to a grand jury.
At the same time, she delayed other hearings without setting a new date.The calendar shuffling is the latest example of Cannon's approach so far to the national security case: scheduling hours in court for arguments that other courts have mostly denied, and pushing off resolution of various legal matters for months.
The delays are a significant legal win for Trump, who also scored a major victory in Georgia on Wednesday, where the state court of appeals put the election subversion conspiracy case there on hold indefinitely.
Challenges to special counsel's office have failed nationwide
Similar challenges from Trump and other high-level targets of special counsel probes have flopped from coast to coast in recent years: Hunter Biden's attorney didn't get anywhere with judges in Los Angeles and Delaware; Paul Manafort's arguments fell flat when the former Trump campaign chairman challenged special counsel Robert Mueller's authority; and Andrew Miller, a former associate of Roger Stone, also lost his challenge to Mueller's authority.
Even with other federal trial-level judges allowing special counsels' criminal prosecutions, Cannon could rule differently.
Cannon's signal of willingness to entertain challenges to the special counsel comes in the same week Republicans are bearing down on Attorney General Merrick Garland for his use of special counsels.
The issue, now before Cannon in the Southern District of Florida federal court, is likely to remain in the political debate at least until Cannon holds a hearing on the legal power of the special counsel to prosecute a defendant, on June 21.
Cannon has already taken a drastically different tack from other trial-level federal judges who have handled criminal cases charged by recent special counsel's offices - of which there have been five since Trump became president.
While others have moved swiftly to trial - including special counsel David Weiss trying his case against Hunter Biden in Delaware this week, eight months after indictment - Cannon has moved slowly on pre-trial issues from Trump and his two co-defendants. Many of the most substantive legal questions to be decided in the classified records case, which the Justice Department first brought against Trump last June,aren't yet ripe for a decision.

Trans Butcher Charged with Abduction, String of Child Sex Offences
Andrew Miller, a transgender butcher who goes by Amy George, has been charged with a string of child sex offences in the Scottish courts.
Miller, 53, was initially charged merely with threatening or abusive behaviour alongside abduction, after an incident in which an 11-year-old girl disappeared from the town centre of Galashiels the Scottish Borders, which triggered search including police divers and mountain rescue teams.
Police Scotland claimed the girl was found "safe and well" at a property in the Galashiels area, but Miller has now been charged with the sexual assault of a young child, sexual exposure, causing a young child to look at a sexual image, and possession of indecent images of children, according to a Sky News report, suggesting the incident may have been much more serious than was originally suggested.
Miller has also been charged with attempting to defeat the ends of justice, although the circumstances in which he is alleged to have done so are unclear.
The authorities have not been especially forthcoming about the case in general, with the transwoman's first court appearance having been held in private.
The former owner of the well-known Millers of Melrose butcher's shop, Miller has been described by both Police Scotland and the Scottish press as a "man" - a somewhat unusual departure from what has become standard practice in recent years, with trans criminals generally having their gender identity accepted at face value.
Miller was a known supporter of the controversial gender self-ID legislation Scotland's departing left-separatist leader, Nicola Sturgeon, attempted to pass through the Scottish Parliament, before the British central government stepped in to block it.
Miller is being held in custody while his case progresses - as of the time of publication he has issued no pleas - and the date of his next court appearance was unconfirmed as of the time of publication.

Ex-MLB pitcher Frankie De La Cruz dead at 37
Frankie De La Cruz, who was among the key prospects traded by the Detroit Tigers to the then-Florida Marlins for Miguel Cabrera in 2007, died of a heart attack on Sunday. He was 37.
De La Cruz's Dominican Winter League team announced the right-handed pitcher's death. The Detroit News first reported the cause of death.

He, Dallas Trahem, Burke Badenhop, Cameron Maybin, Andrew Miller and Mike Rabelo were traded to the Marlins for Cabrera and Dontrelle Willis.
"He was one of those guys that could really light up a clubhouse. And he had quite an arm," Matt Walbeck, De La Cruz's former minor league manager in the Tigers' organization, told The Detroit News. "He threw really hard, straight over the top with a four-seam fastball that touched 100 mph. When he was on, he was fun to watch."

The National Legal and Policy Center, in conjunction with Andrew Miller, a former aide to Roger Stone, filed a complaint against one of Stone's prosecutors who worked with Special Counsel Robert Mueller on the case against Stone. Miller and the NLPC are alleging that prosecutor Aaron Zelinsky engaged in ethical misconduct pertaining to the use of a grand jury in the case against Stone. The 17-page complaint accuses Zelinsky of misleading the court in 2019, in addition to switching grand juries without informing Miller, who was testifying, his attorney or the court. "Mr. Zelinsky abused the grand jury by seeking Mr. Miller's testimony long after Mr. Stone was indicted, which violates Department of Justice policy prohibiting gathering evidence on a defendant after indictment, unless the government was seeking evidence for new crimes against Mr. Stone or other targets. Neither exception appeared to be the case," said Paul Kamenar, a National Legal and Policy Center attorney and counsel for Miller.
Peter Flaherty, the chair of the NLPC, said that Zelinksy's claim that Miller's grand jury testimony was needed for an ongoing investigation was false, as evidenced by the final Mueller report. "Our complaint must be thoroughly investigated and Mr. Zelinsky disciplined if the facts support our claims," he said. Miller and the NLPC filed the complaint with the Office of Professional Responsibility at the DOJ. Earlier this week, Zelinksy testified in front of the House Judiciary Committee that Attorney General William Barr lessened Stone's sentencing recommendation, which Barr changed to 40 months in prison.

Roger Stone aide ends challenge to Mueller
A former aide to political operative Roger Stone appears to have given up a yearlong quest to challenge special counsel Robert Mueller's authority by resisting a grand jury subpoena. The aide, Andrew Miller, threw in the towel Wednesday just as Mueller made a brief but keenly watched public statement a few blocks away marking the end of his investigation.
Miller's arguments against Mueller came up short with a federal district court judge and an appeals court panel in Washington. The former Stone aide faced a stark choice in recent days: testify or take the battle to the Supreme Court and accept the near certainty of being sent to the D.C. jail for contempt of court. Miller's pro bono attorney, Paul Kamenar of the National Legal Policy Center, said Miller agreed to appear later this week before a grand jury that was previously attached to Mueller's probe but is now being handled by the U.S. Attorney's Office for the District of Columbia. "We decided to come to the grand jury on Friday," Kamenar said. "I don't know what they want him to testify about."
Kamenar said he received an email earlier this week from Aaron Zelinsky, a former attorney on Mueller's team who now works for the U.S. Attorney's Office in D.C., saying prosecutors want Miller to testify about his dealings with Stone from 2016 to the present. Stone was indicted in January on charges of lying to Congress and the FBI about his dealings with WikiLeaks during the 2016 presidential campaign. He has pleaded not guilty and is awaiting a trial, set for November.
Under Justice Department policy and court rulings, grand juries are not supposed to be used to investigate a criminal case that's already been filed, although they can be used to add new charges or to charge new defendants. "If they're investigating other crimes then I don't know what else they're looking at," Kamenar said.
Kamenar argued before Chief U.S. District Court Judge Beryl Howell and the appeals court that Mueller's appointment was invalid because he was wielding so much authority that he required a nomination by the president and confirmation by the Senate. The conservative attorney also contended that former Attorney General Jeff Sessions' recusal did not give former Deputy Attorney General Rod Rosenstein the power to name Mueller as special counsel.
Howell rejected the arguments last year, but she wasn't entirely dismissive, saying Kamenar raised "legitimate questions." In February, a three-judge D.C. Circuit panel turned aside Miller's appeal. During a hearing Wednesday, Howell denied Miller's motion to set aside previous rulings in the case and she ordered him to appear before the grand jury Friday at 9:30 a.m. She stayed her earlier contempt order until that time and ordered prosecutors to report to her by next week whether Miller was in compliance with the grand jury's requests.

A federal appeals court denied a request on Monday to rehear a case on whether it was constitutional to appoint special counsel Robert Mueller. In February, the D.C. Circuit Court of Appeals determined Mueller was legally named to the role by Deputy Attorney General Rod Rosenstein to lead the investigation on Russian interference in the 2016 election.
Andrew Miller, who worked for longtime Trump associate Roger Stone and failed to comply with a federal grand jury subpoena to testify about Stone, requested the case be reheard. He argued President Trump should have nominated Mueller and then have the Senate confirm him. His request was rejected by the three-judge panel on the D.C. Trump confidant Roger Stone seeks full Mueller report
President Donald Trump's longtime confidant, Roger Stone, asked a federal judge Friday to compel the Justice Department to turn over a full copy of special counsel Robert Mueller's report on the Russia investigation as part of discovery in his criminal case.
Stone has pleaded not guilty to charges he lied to Congress, engaged in witness tampering and obstructed a congressional investigation into possible coordination between Russia and Donald Trump's 2016 presidential campaign. In a court filing late Friday night, his lawyers said Stone is entitled to see the confidential report - which was submitted to the attorney general late last month - because it would help prove their allegation that there are constitutional issues with the investigation.
In a separate action, a former aide to Stone who was subpoenaed to testify before a grand jury asked a federal appeals court to determine whether he still needs to testify now that the Russia probe has concluded.
In court documents, the lawyers argue they are entitled to a private disclosure of the nearly 400-page report that Mueller submitted to Attorney General William Barr late last month and said they "must be allowed to review the Report in its entirety because it contains the government's evidence and conclusions on matters essential to Stone's defense."
"To be clear, Stone is not requesting the Report be disclosed to the world - only to his counsel so that it may aid in preparing his defense," the lawyers wrote.
Stone, who is set to go on trial in November, has maintained his innocence and blasted the special counsel's investigation as politically motivated. He has pleaded not guilty to the charges, which stem from conversations he had during the campaign about WikiLeaks, the anti-secrecy group that released material stolen from Democratic groups, including Hillary Clinton's campaign.
In a four-page letter to Congress that detailed Mueller's "principal conclusions," Barr said the special counsel did not find a criminal conspiracy between Russia and Trump associates during the campaign, but did not reach a definitive conclusion on whether Trump obstructed justice. Instead, Mueller presented evidence on both sides of the obstruction question, but Barr said he did not believe the evidence was sufficient to prove that Trump had obstructed justice.
Barr has said he expects to release a redacted version of Mueller's report next week that will be sent to Congress and made public.
In the separate case, Andrew Miller, a former Stone aide, filed a petition with the U.S. Court of Appeals for the District of Columbia over the subpoena he was issued in Mueller's investigation.
Last year, Mueller's team sought Miller's testimony regarding Stone, WikiLeaks and the Russian government-controlled online persona Guccifer 2.0, which was used to release hacked material during the 2016 election. But Miller challenged his grand jury subpoena, arguing that Mueller's appointment was unconstitutional.
Earlier this year a three-judge panel of the court upheld the special counsel's appointment and a contempt order intended to force Miller to testify.
In the new petition, Miller's attorney, Paul Kamenar, argued that the matter now appears to be moot because Stone has been indicted and like "Cinderella's carriage that turned into a pumpkin at midnight, special counsel Mueller's authority expired."
Kamenar is now asking the court to have the government formally say whether it will still pursue Miller's testimony. If that's the case, Kamenar is asking for a rehearing of the case. He said in a statement that he will take the fight to the Supreme Court if necessary.

Mueller team signals to Stone associate another indictment may be in the works
A defense attorney for Andrew Miller, who's fighting a subpoena from Robert Mueller's investigation into Russian interference in the 2016 election, learned Monday afternoon that the special counsel still wants witness testimony for a federal grand jury.
Paul Kamenar, the defense attorney, says the assertion from Mueller's team made clear to him that Mueller and the Justice Department are considering an additional indictment of Roger Stone or have plans to charge others.
The development sets up the potential for another twist in the Russia probe. It comes hours after acting Attorney General Matthew Whitaker said that Mueller's investigation was "close to being completed."
Kamenar's client is Miller, a former employee of Stone's whom Mueller subpoenaed in mid-2018 to testify to the grand jury. In a court hearing about Miller's testimony, a judge made clear that Mueller sought information Miller had about Stone's communications regarding Wikileaks and Russian hackers around the time they disseminated damaging hacked Democratic emails.
"The special counsel has advised me the grand jury is still interested in Andrew Miller, and they consider the case still a live case," Kamenar told CNN late Monday afternoon.
Miller faces no criminal charges.
Stone was indicted by the grand jury on Thursday for lying to Congress, witness tampering and obstruction of justice – but the court papers against him alleged no crimes regarding actual contact between Americans and Julian Assange and the Russians. Stone will be arraigned in Washington Tuesday morning.
A separate but related criminal case against Russian intelligence officers alleges Stone was in contact with them about the hacked documents in 2016, but Stone was not named in that case.
Months ago, Miller spoke to the FBI and turned over digital records to Mueller that he had related to Stone, Wikileaks, Assange, the Democratic National Committee and the online monikers the Russians used after they hacked the Democrats.
When Miller received the subpoena for testimony, he refused to visit the grand jury, and a federal judge held him in contempt of court. The punishment was imprisonment. But Miller hasn't yet been jailed or given the testimony.

BROWARD COUNTY, Fla. - When Local 10 investigative reporter Bob Norman confronted the nationally notorious political dirty trickster Roger Stone – now a top campaign strategist for Sheriff Scott Israel – about a $1.5 million federal tax lien recently filed against him in Broward County, Stone didn't take it well. He attacked physically and verbally.
"You smell like alcohol," Stone said to Norman at his door.
Both Norman, who laughed at the assertion as Stone shut his door, and Local 10 photographer Bob Palumbo attest that it wasn't true, but it didn't take long for Stone, who began his political career with Richard Nixon and is a former business partner of Ponzi schemer Scott Rothstein, to ramp up one of his patented smear jobs on Norman based on the false allegation.
Later that day, Stone fed his spin to a small Deerfield Beach blog which alleged that Norman "reeked of alcohol" and was "drunken" during his encounter with Stone. He's quoted in the blog post calling Norman a "psycho," among several other loaded names. He also claimed Norman "snapped" and that he "accosted" his wife.
The video shows that it was Stone who lashed out at the camera and his wife, who tried to hit him with a car cover for his Jaguar.
After a letter from a Local 10 attorney, the blog post was taken down and retracted, but Stone does much of his name calling in Broward on the Broward Bugle, a campaign and propaganda website for Israel that he founded in 2012 with current BSO general counsel Ron Gunzburger.
Today it's published by long-time Stone cohort Andrew Miller, whose stepmom Dianne Thorne and fiancée Jen Hobbs have been hired by Israel to work at BSO, with Thorne rising to the title of assistant to Israel's chief of staff.
Miller also gave a mysterious $120,000 contribution to a PAC supporting Israel in the 2012 campaign. Norman went to Miller's shuttered working class home in Margate that he owns with Hobbs to ask him where he got that money. No one answered the door, but Miller tried to make the visit to his house by Norman into a sex crime on the sheriff-tied Bugle. Hobbs drew up fake police sketch of Norman and Miller claimed Norman was a "peeping Tom" who was wanted by the police – all of it false, though the blog post did get the attention of the Margate Police Department.
Israel declined an interview request to talk about his association with Stone, the use of a campaign website by Stone and the hiring of Stone's cohorts with taxpayers' money.
Stone has a long track record in dirty tricks, having practiced what he at times calls the "dark arts" of politics with the likes of the late GOP operative Lee Atwater and infamous Joseph McCarthy attorney Roy Cohn.
Former New York Libertarian gubernatorial candidate Warren Redlich got a crash course in Stone's brand of politics in 2010. At the time, Stone was overseeing the campaign of convicted prostitute Madam Kristin Davis, who recently pleaded guilty to dealing in prescription pills. Stone was involved in issuing a bogus "sex predator alert" mailer on Redlich that was sent to his neighbors and his town saying he was "sick twisted pervert" and urging people to call the police if they saw him near a school. Redlich, who has since moved to Boca Raton, is a family man with no criminal record and is now suing Stone for defamation.
"This was designed to punish me, to punish my wife, to punish my family," Redlich said. "The dark side of politics is lying and particularly smearing other people, other candidates. We talk about Roger Stone, that's his specialty… He brags about being evil."

Mystery company involved in Mueller investigation appeals to Supreme Court
Washington (CNN)An unnamed, foreign government-owned company in a mystery court case is asking the Supreme Court to pause a grand jury subpoena it received related to special counsel Robert Mueller's investigation.
The Supreme Court appeal comes after a federal appeals court ruling that ordered the company to comply with the subpoena, which required it to turn over "information" about its commercial activity in a criminal investigation. The appeals court also said the company could face fines for every day of noncompliance.
The request to the Supreme Court is the latest twist in the secret case, which is under seal and has made its way through the federal court system with uncommon speed.
This is the first known legal challenge apparently related to Mueller's investigation to make its way to the Supreme Court.
It is not known when the court might decide if it will take action on the company's request to appeal further. The application is likely an effort to put the lower court action on hold before the Supreme Court is asked to step in to hear an appeal.
"So far as we know, the Court has never had a sealed argument before all nine Justices," said Steve Vladeck, a CNN Supreme Court analyst and professor at the University of Texas School of Law. "They can keep parts of the record and briefing sealed, and often do, such as in cases implicating trade secrets. But there's no procedure in the court's rules for having the whole case briefed, argued and decided under seal. The only times I'm aware of in which parties tried it, the court denied certiorari," or the review of the case.
The company's challenge of the subpoena appears to have begun in September.
In its ruling this past week, the US Circuit Court of Appeals for the District of Columbia offered few clues about the company and its country of origin or what Mueller's team sought.
In one short passage in the three-page decision, the judges describe how they had learned confidentially from prosecutors that they had "reasonable probability" the records requested involved actions that took place outside of the United States but directly affected the US. Even the company was not informed of what prosecutors had on the issue, because revealing it to the company would have violated the secrecy of the grand jury investigation, the judges said.
The range of possibilities on the identity of the company is vast. The company could be anything from a sovereign-owned bank to a state-backed technology or information company. Those types of corporate entities have been frequent recipients of requests for information in Mueller's investigation.
And though Mueller's work focused on the ties between the Trump campaign and Russia's efforts to interfere in the 2016 presidential election, prosecutors have said and CNN has reported that the Mueller team looked at actions related to Turkish, Ukrainian and other foreign government interests.
Mueller previously indicted three Russian companies and 25 Russians for their alleged contributions to a social media propaganda scheme meant to influence American voters and to the hack of the Democratic Party. The special counsel and other Justice Department units continue to pursue several investigations related to Mueller's core mission.
Another challenge of a Mueller subpoena, from Roger Stone associate Andrew Miller, began at the trial level months before the anonymous company's action apparently began. Miller's case is now before the DC Circuit as well but has not yet been decided by the judges. His case became public after his attorneys publicly spoke about his intention to challenge Mueller and the subpoena.
The company in the Supreme Court challenge has stayed secret-as has the grand jury proceeding it's related to. And both the company, prosecutors and the circuit court took pains to keep the identities of those involved in the case under wraps. An entire floor of the DC federal courthouse was locked down by security on the morning of the company's appeal argument, so that the lawyers entering and leaving the courtroom would not be seen.

A U.S. Justice Department attorney on Thursday spelled out the circumstances under which Special Counsel Robert Mueller could be fired in a court case that took on new significance this week after President Donald Trump ousted his attorney general. The case, argued on Mueller's behalf by Deputy Solicitor General Michael Dreeben who is working temporarily on assignment in Mueller's office, started months ago as a challenge to the legality of Mueller's appointment and his authority. When Trump ousted Attorney General Jeff Sessions on Wednesday and replaced him with Matthew Whitaker, Democrats in the U.S. Congress immediately warned that Trump might be moving to dismiss Mueller and squash his probe.
The 18-month-old Mueller probe into Russian meddling in the 2016 U.S. presidential election and possible collusion between Moscow and the Trump campaign has clouded the Trump presidency. Russia denies it meddled in the election. Trump, who frequently blasts the Mueller probe as a "witch hunt," denies any campaign collusion with the Russians. In May, Andrew Miller, who is an associate of long-time Trump adviser Roger Stone, refused to comply with a grand jury subpoena from Mueller. Miller was held in civil contempt. He filed a legal challenge, asserting Mueller has no authority to compel his testimony or to oversee the probe because he was illegally appointed.
Dreeben told a three-judge appeals panel on Thursday that there are checks and balances on Mueller's activities that make his appointment lawful. One of these is that he could be fired by Whitaker, now acting attorney general, if Whitaker revoked department regulations governing Mueller's appointment to make him fireable without cause. The special counsel is not "off in a free-floating environment," Dreeben said in arguments before the U.S. Court of Appeals for the District of Columbia Circuit that attempted to show Mueller's power is circumscribed by the law. Central to the case is whether Mueller is an inferior or a principal officer under the Appointments Clause of the U.S. Constitution. Dreeben argued Mueller is an inferior officer and subject to the direction and supervision of presidentially appointed officials.
Miller's attorney Paul Kamenar argued Mueller is a principal officer and cannot be fired except for good cause. Mueller was named special counsel by Deputy Attorney General Rod Rosenstein after Sessions recused himself from the probe. Rosenstein lost his role as Mueller's supervisor to Whitaker on Wednesday when Sessions was forced out by Trump. Whitaker has been critical of Mueller's probe in the past and Democrats in Congress have called on him to recuse himself. Trump's personal attorney Jay Sekulow said he has have "no idea" about the case when shown the docket. Roger Stone's attorneys similarly said that they didn't know of anyone challenging a Mueller subpoena aside from Miller, while other attorneys representing other witnesses in the Russia probe say they are unaware of who might be trading barbs with Mueller's team. So the mystery witness remains a mystery - while their legal team filed a joint motion with the special counsel's office earlier this month asking the court of appeals to expedite resolution of the dispute. What is known about the mostly sealed dispute based on the DC Circuit's docket is that the case was brought on August 16, and Judge Howell ruled on it September 19, with an initial appeal filed five days later.
"The bottom line is the most likely scenario is someone filed a motion to quash or otherwise resisted a grand jury subpoena, and the judge issued an order denying that and saying the witness needs to testify," said Gibson Dunn & Crutcher attorney Ted Boutrous, whose firm has handled grand jury-related litigation for media organizations and journalists.

Special counsel Robert Mueller gave a history lesson while defending his authority to investigate possible collusion between President Trump's 2016 campaign and the Russians.
In a legal filing, Mueller cited scandals going back to former President James Garfield's day in 1881 to make the point that attorneys general have long relied on special prosecutors, Politico reported Friday.
Mueller is fighting an effort by Andrew Miller to avoid subpoenas. The former aide to Trump advisor Roger Stone doesn't want to fork over documents or give testimony.
A similar strategy failed for Trump's former campaign chairman, Paul Manafort, and a Russian company charged in connection to a Kremlin-linked online troll farm accused of targeting the American elections.
Miller's defense team has until Oct. 9 to reply. The court case is scheduled for Nov. 8.

'Manhattan Madam' to testify before Mueller grand jury: report
"Kristin Davis is a long time friend and associate of mine," Stone said in a statement for CNN. "I am the Godfather to her 2 year-old son. She knows nothing about Russian Collusion, WikiLeaks collaboration or any other impropriety related to the 2016 election which I thought was the subject of this probe. I am highly confident she will testify truthfully if called upon to do so."
Stone also revealed in June that he met with a Russian man who offered dirt on Hillary Clinton during the 2016 campaign in exchange for $2 million from then-candidate Trump. Stone said he rejected the proposal.
Mueller's team appears to be building a case against Stone. A federal judge in recent weeks ordered Stone associate Andrew Miller to also testify before Mueller's grand jury.

11:59 a.m.: Judge confirms lawfulness of special counsel's appointment
With Manafort's trial pressing forward, a federal judge in D.C. on Thursday affirmed the legal legitimacy of Special Counsel Robert S. Mueller III's appointment.
In a 93-page opinion, Judge Beryl A. Howell wrote that Mueller's power "falls well within the boundaries the Constitution permits," because he was supervised by an official who was himself accountable to the president. She wrote that "multiple statutes" authorized Mueller's appointment, and Deputy Attorney General Rod J. Rosenstein, who named him to the post, "had power to do so."
The opinion came in response to a legal challenge from a witness who was arguing he could not be compelled to testify before a grand jury. The witness argued that Mueller wielded too much power and was appointed unlawfully. In the witness's view, Mueller should have been nominated by the president and confirmed by the Senate, and there was no statute giving Rosenstein the authority to appoint him.
The witness was not named, though his attorney told The Post's Manuel Roig-Franzia it was Andrew Miller, an associate of political operative and Trump adviser Roger Stone.
The ruling from Howell won't have any direct bearing on Manafort's case. Manafort himself had sought to challenge Mueller's authority in the case against him in D.C. - though he abandoned part of that, and a judge rejected his request to stop Mueller from bringing charges against him in the future. Judge T.S. Ellis III also earlier rejected an effort by Manafort to get the charges against him in Virginia thrown out.

The already hugely delayed ferry being built at Ferguson Marine has been delayed once again, days after Kate Forbes offered assurances to MSPs that it will be ready on time. The Glen Sannox's completion date has been set back by another three weeks due to issues with installing its dual fuel system.
Critics blasted this "catastrophic failure" which means that islanders will be stuck using CalMac's unreliable and ageing ferries for another busy summer season. And they pointed out that no one has ever lost their job within the SNP Government for presiding over the scandal.
There have been difficulties with the much boasted about liquefied natural gas (LNG) equipment which is meant to be environmentally friendly fuel. It will be used to power the two ships along with traditional diesel.
The Glen Sannox was meant to be delivered to CalMac for trials on July 31 but now will not be handed over until at least August 19. The boat will need to be tested out for two months before it can serve islanders, meaning that it will probably not be in service until late Autumn.
Deputy First Minister Ms Forbes refused repeatedly on Tuesday to say whether the ferry delivery would be delayed again after the shipyard sacked its project manager. She told MSPs that she met Ferguson Marine chairman Andrew Miller and interim chief executive John Petticrew a few weeks and ""both of them confirmed to me that they see no change to the commitment to deliver the vessel by the end of July."
But she faced accusations that she was attempting to shy away from criticism by announcing the delay after Holyrood broke off for recess, which is exactly what happened. The Glen Sannox should have been completed six years ago and serving the busiest CalMac route between Arran and Brodick.
However, the construction has been beset with delays and issues, including the shipyard plunging into administration and having to be nationalised. The cost of the two ships has also sky-rocketed from ?97m to close to ?500m.
In the latest progress update published on Friday, Ferguson Marine also admitted that work on the Glen Rosa was "not at the rate we would like to see", but did not signal any delays or cost increase. Mr Petticrew said: "The LNG system has been well documented as the biggest challenge we were facing since our last report.
"It has proved even more difficult and has impacted the progress in other areas, namely the engine compartments. We still have a small portion to complete in the commissioning, but this has been moved to an alternate shift so as not to have further interference with other critical activities.
"This has resulted in a movement of the schedule causing a slight delay, with delivery now being the week commencing August 19. We are working with CalMac and [Scottish Government ferry owners] Caledonian Maritime Assets Limited at the highest level to ensure there will be no further delays.
"Regarding the final cost to go, we have reviewed the status and even with the revised delivery date, we remain confident within the range previously forecast, namely the ?145.5 million to ?149.1m."
