Ohio Gov. Mike DeWine announced Thursday that Dr. Amy Acton was stepping down as director of the Ohio Department of Health and that Lance Himes will take over as interim director.
The transition will be immediate, Acton said.
Himes has been serving as general counsel for the department, where he has worked for over 15 years.
In 2017, Gov. John Kasich appointed Himes to lead the Department of Health.
According to the department's website: "Himes's legal work focused primarily on environmental health and compliance issues. One of his chief accomplishments was the successful legal implementation of Ohio's smoke-free workplace law and rules. He also played a leading role in an extensive overhaul of Ohio's sewage treatment regulations; helping reform a set of laws that had not been updated since 1977."

The Ohio Department of Health is dragging its feet on an Ohio public records request from a public policy group seeking information about models used by the health director to make decisions related to the state's COVID-19 response. In delaying the request, the health department cited an obscure passage tucked into a bill passed in March and signed into law by Governor Mike DeWine, which they say allows them to delay records requests until 90 days after the current state of emergency is lifted. Senate Leader Larry Obhoff says they're misinterpreting the language and improperly denying the request.
In April, the Ohio Roundtable, a division of the American Policy Roundtable, filed a Freedom of Information request with Dr. Amy Acton, who was the director of health at the time. The purpose of the request, according to the nonpartisan public policy group, "is to permit all Ohioans to 'see the math' behind the construction of Dr. Acton's latest model, which is controlling public policy decisions in Ohio," including mandatory business and school closures and stay-at-home orders.
DeWine and officials at the Ohio Department of Health have been under fire in recent months for what many consider to be their heavy-handed approach to the virus and the lack of transparency coming from state government about how decisions that affect the lives of 11.69 million Ohioans are being made.
"From the start of this crisis, Dr. Acton's models have driven public policy in Ohio," said Rob Walgate, vice president of the American Policy Roundtable, in an April 3 press release. "These policies are now creating tremendous hardships across the state at every level. Unemployment is skyrocketing, civil liberties are evaporating, people are being spied upon, harassed and threatened with arrest for standing too close to each other."
"While promising transparency, Dr. Acton has openly admitted to 'guesstimating' on her numbers," he added. "Now, her latest model is buried in secrecy at Ohio State University and no one is permitted to see the math." The lack of transparency led the organization to file a formal records request, which, by law, must be fulfilled "promptly" and within "a reasonable period of time."
But that's not what happened. Instead, Robert M. Laubert, senior counsel for the Ohio Department of Health, sent a letter to the Roundtable saying he could not provide the group with a "realistic estimate" for when the request might be fulfilled. He said that state employees being required to work from home "may result in a delay" in processing the request.
Further, he said a provision in a bill passed at the end of March "had the effect of extending the deadline by which the Department of Health must respond to all of the public records requests it receives under section 149.43 of the Ohio Revised Code."
"The new deadline is now 90 days after the state of emergency declared by Governor DeWine is lifted, or December 1, 2020, whichever date occurs first," the health department's attorney wrote. He assured the Roundtable that the department has "no intention of waiting that long" to fulfill the request and promised to provide the group with the records they are requesting "as quickly as possible."

"While I'm pleased that Dr. Acton will continue to advise Governor DeWine on health issues, I can't help but be disappointed by her resignation as health director," Kenny Yuko, the state Senate's minority leader, a Democrat, told the Columbus Dispatch. "She endured an incredible amount of unfair criticism, including some antisemitic attacks. All those who have insulted, harassed or threatened her and her family should be ashamed."
Acton appeared on a CNN town hall co-hosted by "Sesame Street" on Saturday.

Lucci's ruling was in response to a May 8 lawsuit filed by 1851 Center for Constitution law on behalf of Rock House Fitness Inc, and 34 other gyms, which have been deemed nonessential businesses and thus told to stay closed under Ohio's statewide "Stay Safe Ohio" order.
"Constitutions are written to prevent governments from arbitrarily interfering in citizens' lives and businesses," said 1851 Center Executive Director Maurice Thompson, according to Cleveland 19 News.
"On that front, the call to action is clear," he added. "The Governor and health director may no longer impose their own closures and regulations and write their own criminal penalties to enforce those regulations and closures."
In issuing her orders, Acton relied on a statute that grants her department "ultimate authority in matters of quarantine and isolation."
Lucci, however, says that Ohio law only permits Acton to "isolate" the sick and "quarantine" those who have been exposed to an illness during the period of incubation for the disease, and that in the case of the Wuhan coronavirus, the incubation period is 14 days.
Therefore, Judge Lucci has concluded that Acton's powers are to stop after 14 days.
"The director has quarantined the entire people of the state of Ohio, for much more than 14 days," wrote Lucci. "The director has no statutory authority to close all businesses - which she deems non-essential for a period of two months."

- First, I believe that this virus was not naturally occurring, but genetically manipulated. I still have not formed an opinion as to whether the release was accidental or intentional.
- I think this virus has been present at least several months prior to being recognized.
- People need to understand that the entire draconian response that we are witnessing was designed with a mission statement to "flatten the curve". Not to save lives, reduce deaths or anything like that. Flattening the curve is like squishing a water balloon. You done change the volume in the end. You just spread things out over a longer period of time- thereby not overwhelming the hospitals.
- New York and Ohio are different. So is Wyoming and South Dakota and every other geographic area in the country. It made and makes no sense to develop blanket policies and apply them to a very big and diverse country. This includes nearly every policy developed by medical professional organizations, regulatory bodies, state and local health departments and the government as a whole.
- I believe Amy Acton in Ohio is a very smart person and has the best intentions at heart, but she suffers from tunnel vision and lacks "operational experience". She was assigned a mission and will do anything to complete it- without taking into the account all of the impact and unintended consequences her decisions caused. I don't fault her, I was once a 'young' battalion surgeon at a Combined Arms Exercise (CAX) with 3/25 Marines. I had tunnel vision then and didn't give a rat's ass about anything but taking care of my battalion. Later as a little older Regimental surgeon and the MAGTF surgeon at CAX, I had a new perspective. Now I was the one all of the other medical personal below me bitched about, claimed I was taking their assets or personnel. It was because now I was responsible for not just a battalion, but an entire Marine Air Ground Task Force. And more importantly, not only was I responsible for the medical care of the MAGTF, my overriding and primary objective was to compete the assigned mission of the commanding general. Way to many policies and decisions were made based on the wrong "mission statement". In my opinion, the mission statement should have been something like "To develop policies and procedures to mitigate/minimize the impact of COVID-19 on the population and the normal operation of the country..."

Acton, whose order in mid-March delayed the Ohio primary election citing a "public health emergency," in the state amid the coronavirus pandemic, had recently issued an order which delayed the re-opening of gyms and fitness centers until May 26.
The ruling in favor of Rock House Fitness from Judge Eugene A. Lucci allows the business to reopen by stating that Acton's orders violated the constitutional rights of such businesses.
From Lucci's nine-page ruling: "The director has quarantined the entire people of the state of Ohio, for much more than 14 days. The director has no statutory authority to close all businesses, including the plaintiffs' gyms, which she deems non-essential for a period of two months. She has acted in an impermissible arbitrary, unreasonable, and oppressive manner and without any procedural safeguards."
The court's ruling also allows Rock House Fitness to seek damages for the money their business lost while shutdown under Acton's order. Additional suits alleging violation of constitutional rights of businesses have been filed across the state of Ohio and the United States.

I watched the local and national news, I tract data from numerous sources, I read people responses and comments on social media. As time went on, the dots became less and less connected. Things didn't and don't add up. I am no longer skeptical, now I am convinced that this entire "pandemic' has been massively mismanaged and when this is looked at retrospectively in the future, nothing short of a massive Charlie Foxtrot. Several comments/observations:
- First, I believe that this virus was not naturally occurring, but genetically manipulated. I still have not formed an opinion as to whether the release was accidental or intentional.
- I think this virus has been present at least several months prior to being recognized.
- People need to understand that the entire draconian response that we are witnessing was designed with a mission statement to "flatten the curve". Not to save lives, reduce deaths or anything like that. Flattening the curve is like squishing a water balloon. You don't change the volume in the end. You just spread things out over a longer period of time- thereby not overwhelming the hospitals.
- New York and Ohio are different. So is Wyoming and South Dakota and every other geographic area in the country. It made and makes no sense to develop blanket policies and apply them to a very big and diverse country. This includes nearly every policy developed by medical professional organizations, regulatory bodies, state and local health departments and the government as a whole.
- I believe Amy Acton in Ohio is a very smart person and has the best intentions at heart, but she suffers from tunnel vision and lacks "operational experience". She was assigned a mission and will do anything to complete it- without taking into account all of the impact and unintended consequences her decisions caused. I don't fault her, I was once a 'young' battalion surgeon at a Combined Arms Exercise (CAX) with 3/25 Marines. I had tunnel vision then and didn't give a rat's ass about anything but taking care of my battalion. Later as a little older Regimental surgeon and the MAGTF surgeon at CAX, I had a new perspective. Now I was the one all of the other medical personnel below me bitched about, claimed I was taking their assets or personnel. It was because now I was responsible for not just a battalion, but an entire Marine Air Ground Task Force. And more importantly, not only was I responsible for the medical care of the MAGTF, my overriding and primary objective was to compete the assigned mission of the commanding general. Way too many policies and decisions were made based on the wrong "mission statement". In my opinion, the mission statement should have been something like "To develop policies and procedures to mitigate/minimize the impact of COVID-19 on the population and the normal operation of the country..."
- This virus is much more prevalent than reported or realized, some studies suggest that that may be 50 times or more people exposed than detected. I suspect that it is much larger than that. So, if we accept the 50 X number, for every diagnosed case, there are 50 people out there that have it. Of those diagnosed, 80-90+% have either no symptoms or minimal to moderate symptoms. A small percentage get seriously sick, and many will die. Those that die in general are old, have other medical issues and comorbidities. Yes, I know, there are the occasional children and young people that get sick, have other manifestations (Kawasaki like illnesses, strokes, etc., etc.), however you see that in most viral illnesses, such as the flu. It just receives absolutely no attention from the media or social media.
- This virus will run its course and we can't stop it. We may change it's velocity or trajectory, but in the end, the same number of people will die. Keep that in mind. The same number will die. We have destroyed the economy and in the end the only thing we will be able to show is an economy in shambles and policy changes that have far reaching and irreversible consequences.

Yet another round of protests over the state's social-distancing rules took place on the capitol grounds in Columbus on Friday. According to WSYX, some protesters tried to open the building's basement windows and yell into them just as DeWine's daily briefing began, reminiscent of the protesters who pressed themselves up against the glass at the same building last month. But what really caught the governor's eye were the people some of the demonstrators were yelling at: reporters and the state health chief.
Videos showed one protester antagonizing an NBC4 Columbus reporter in a face-mask, ignoring the reporter's requests to stay six feet away while accusing the reporter of "terrifying the general public."
"You know that the company you work for is lying to the American people," the protester yelled.
Later, roughly two dozen demonstrators showed up at the private family home of Ohio Department of Health Director Amy Acton on Saturday, holding signs that said, "Dr. Over-Re-Acton Hairstylists are Essential" or "Let Freedom Work," Cleveland.com reported."

Ohio Protesters Claim Coronavirus Shutdowns Violate Their Constitutional Rights
These Ohio protesters obviously aren't the only Americans concerned about how the pandemic has already affected their livelihoods and their liberties. They aren't the only ones concerned that it may get worse - much worse.

Around 75 protesters gathered outside of the Ohio Statehouse on Thursday to criticize the government's restrictions during the coronavirus outbreak.
Many wore Guy Fawkes masks over their faces, and at least one held a gun. Their signs criticized the governor's stay-at-home order, closure of schools and shutdown of the economy: "My constitutional rights are essential," "Ohio dies when government lies," "Quarantine the sick not the Constitution," "A free people in a pandemic are still a free people."
Ohio Department of Health Director Amy Acton acknowledged the chanting that often could be heard during Thursday's press conference. "There are people protesting right now outside the Statehouse. And people are worried. They're afraid. They're afraid about things like their jobs," she said.
Earlier in the day, the Ohio Department of Jobs and Family Services reported that 695,519 residents had submitted jobless claims over the past three weeks.
DeWine said the protesters had every right to be there, although he urged them to "try not to shout on each other." The state's ban on mass gatherings includes allowances for expressing First Amendment rights.

IndyCar was scheduled to open its season Sunday on the streets of St. Petersburg, Florida, but suspended it's season through the end of April. Four races are affected.

Alabama has its first confirmed case of the coronavirus, according to a press release from Governor Kay Ivey obtained by our affiliate WIAT.
There were rumors of coronavirus cases before Friday morning, however state health officials say these were untrue. The first case was actually discovered and confirmed at 8 a.m. CT.
The coronavirus patient had traveled out of state and was self-isolating at home since they started feeling unwell. Alabama health officials say this person had chronic health conditions, and therefore, was considered a high-risk patient.

This was done after four long years of litigation, which culminated in the Ohio Supreme Court twice refusing to hear an appeal of a 2015 order to deny Haskell's facility an abortion license for failure to meet licensing requirements.
The move to license Haskell's dangerous abortion facility under the new DBA, which appeared to have been created on the fly to evade the licensing denial order, angered pro-life activists who had hoped the Department of Health would fight to save lives and diminish risks to women.
"The entire move to license the Women's Med Center was underhanded and deceptive," said Operation Rescue President Troy Newman. "It is obvious that there was coordination between Acton and Haskell to pull a fast one on the people of Ohio and the Attorney General's office, which spent untold time and resources over four years to successfully enforce the original licensing denial order."

In 2008, Acton went by the name of Amy Beech. She had married Douglas W. Beech in 1989, and together they had three children. During the 2008 Presidential Campaign, Amy and her entire family were featured in a Wired.com article published on March 3, 2008. Amy Beech was a volunteer organizer for the Obama campaign who organized events, managed e-mail lists, and engaged potential voters on Facebook, with the help of her son, who was then 16 years old.
Amy and Douglas Beech filed for divorce later that year, and in 2010, Amy married Eric Raymond Acton and assumed his last name.
The appointment of a Democrat political activist, fundraiser, and part-time doctor as Executive Director of the Ohio Department of Health, which has licensing and oversight authority over abortion facilities, raises questions about the vetting process that DeWine's office engaged in prior to Acton's nomination.
All information about Acton's leftist political activism and her work as a manager of grants for Ohio Planned Parenthood and NARAL organizations, which was previously reported by Operation Rescue, is readily available through simple internet searches.
"The Democrat Party is not known to have a 'big tent' philosophy when it comes to abortion," said Newman. "Obama was an open supporter of abortion and a cheerleader for Planned Parenthood. Those who actively campaign for Democrat candidates that support abortion really can't be considered neutral on that issue."
This also raises the question of whether deception was used by Acton to get the job.

COLUMBUS - Ohio's schools will close for at least three weeks, starting at the end of classes Monday, as state health officials work to limit the spread of coronavirus.
Gov. Mike DeWine announced Thursday that public and private, kindergarten through 12th-grade schools will close from Tuesday through April 3. It's not yet clear how the closure will affect state testing. DeWine said the closures do not include preschools and child care centers.
DeWine said he knows this will be unwelcome, disruptive news for parents statewide.
"We have compassion for that," DeWine said. "But we have a responsibility to save lives."
DeWine acknowledged school closures could disrupt services including meals and state officials will support local efforts to address student needs.
The goal of these cancellations is to prevent the possible spread of disease. If too many people become sick too quickly, that could overwhelm hospitals, leaving them without enough beds or ventilators for patients.
Although children who contract COVID-19, a disease caused by the coronavirus, typically present mild symptoms, they can be carriers for the virus.

As of Thursday, five people in their 50s in northeastern Ohio had tested positive for COVID-19. State health officials expect those numbers to rise in the coming days.
"We must treat this like what it is and that is a crisis," DeWine said. "A crisis like most of us have not seen in our lifetimes."
Ban on large gatherings
The state is also prohibiting most gatherings of 100 people or more. The ban applies to indoor gatherings in arenas, theaters, conference rooms, fairs, festivals and parades.
The ban does not apply to:
airports
buses or train stations
libraries
shopping malls
grocery stores
athletic events without spectators beyond relatives and media
religious services
weddings
funerals
If someone violates the ban on large gatherings, police could break it up, said DeWine, adding that is not the goal. He hopes everyone will abide by the limit.
DeWine's order came as New York Gov. Andrew Cuomo banned gatherings of more than 500 people.
Ohio is also prohibiting all visitors at nursing homes and state psychiatric hospitals.
"This is not something that we want to do," DeWine said. "This will not last forever. This is temporary."
DeWine's promise to ban large gatherings in Ohio on Wednesday triggered a domino effect in the sports world. The NCAA first said it would ban spectators at March Madness basketball tournaments before canceling them Thursday. The National Basketball Association, National Hockey Association and Major League Soccer suspended their 2020 seasons.
Election Day is not considered a large gathering and will continue as planned on Tuesday. Election officials are looking for more poll workers, especially younger individuals, to help with voting.
More tests conducted
Ohio Health Department Director Dr. Amy Acton said the state has received two additional test kits and now has the capacity to test 1,200 to 1,500 people. The state lab east of Columbus has added a third shift to return test results around the clock.
Ohioans feeling ill with coronavirus symptoms - fever, cough, shortness of breath - are advised to call their health care provider. Tests can only be conducted if ordered by a physician and will be given to those at highest-risk. As of Thursday afternoon, 30 people had tested negative and 52 were awaiting test results.
Because recent positive cases did not travel abroad or come into contact with someone who did, health officials are assuming community spread of the disease. That means, Acton said, it's likely 1% of Ohio's population - more than 100,000 people - already have the virus.
Acton said Ohio may soon stop testing in this manner because up to 70% of the state's population will have the virus.
