'Kellyanne Conway's husband counters Trump argument that Mueller appointment was 'unconstitutional''
The husband of White House counselor Kellyanne Conway on Monday blasted legal arguments promulgated by President Trump that assert Robert Mueller's appointment as the special counsel in charge of the federal Russia investigation was unconstitutional.
"There is absolutely nothing wrong with lawyers making inventive and novel arguments on behalf of their clients, or on behalf of causes or people they support, if the arguments are well-grounded in law and fact, even if the arguments ultimately turn out to be wrong," George Conway wrote in a lengthy blog post for Lawfare.
"But the 'constitutional' arguments made against the special counsel do not meet that standard and had little more rigor than the tweet that promoted them," he continued.
Conway, a lawyer who was once shortlisted as a possible candidate for Trump's U.S. solicitor general, said "a good guess" as to where Trump first learned of constitutional criticisms of Mueller is in a series of opinion pieces written by Steven Calabresi, a conservative legal scholar and co-founder of the Federalist Society, in May. The president then tweeted about them in June.
In the articles, Calabresi lays out why he believes that Mueller's probe is unconstitutionally "null and void" because his selection specifically violates the U.S. Constitution's Appointments Clause and the separation of powers doctrine more generally.
But Conway on Monday countered that "there is no serious argument" that Mueller's job under the Justice Department's own regulations infringes either of those principles.
"Such a lack of rigor, sadly, has been a disturbing trend in much of the politically charged public discourse about the law lately, and one that lawyers - regardless of their politics - owe a duty to abjure," Conway added.
Deputy Attorney General Rod Rosenstein, a Trump appointee, chose Mueller, a former FBI director, on May 17, 2017, to lead the federal investigation into Russian meddling in the 2016 campaign.
But as pressure mounts as a result of the probe, Trump tweeted on June 4 that Mueller's appointment was "totally unconstitutional."
"Despite that, we play the game because I, unlike the Democrats, have done nothing wrong!" he wrote.

This is not the first time Conway has been critical of Trump, despite his wife's high-profile role within his administration.
He took a veiled shot at Trump in May for repaying his personal attorney Michael Cohen the $130,000 he gave to former adult film actress Stormy Daniels as part of a nondisclosure agreement, suggesting it flouted Federal Election Commission rules.
In March, Conway also said it was "flabbergasting" that a top lawyer for Trump would consider pardons for former Trump campaign chairman Paul Manafort and ex-national security adviser Michael Flynn.
Lawfare was co-founded by Benjamin Wittes, a friend of former FBI Director James Comey, who was fired by Trump last year.

White House launches anti-opioid public service campaign
The Trump administration on Thursday launched an anti-opioid advertising campaign that depicts shocking true-life stories aimed at deterring young people for drug use.
The ads will target an 18 to 24 year old age group through digital platforms, social media and television, according to the White House.
It is the Trump administration's first public service advertising campaign. It is also this nation's first multiple advertising and awareness campaigns targeting young Americans and the opioid crisis.
White House senior adviser Kellyanne Conway said the campaign would "raise awareness, incite action and literally save lives."
"Our goal is to show the dangers of misusing opioids and how quickly one can become addicted to opioids - as short as five days," she said.
She said that the campaign, while targeting youths, would also encompass an audience of 15 to 34 year olds.
The first set of four advertisements for the "Stop Youth Opioid Abuse" campaign bring to life the stories of four young Americans who, in pursuit of more opioids, go to extreme lengths to feed their addiction.
In one story, a young woman unfastens her seat belt and purposeful crashes her car at high speed into a garbage dumpster, self-inflict injuries to get a opioid prescription.
President Trump has made combating opioid addiction epidemic a priority since taking office. In October, he directed the Department of Health and Human Services to declare the opioid crisis a nationwide Public Health Emergency, and this year launched an initiative to reduce drug supply and demand in the U.S.
A billionaire who donates his government salary, Mr. Trump handed a $100,000 check to HHS in November to help the agency develop the campaign.
He's also cast the issue in personal terms, saying his brother, Fred, died of alcoholism in his 40s. Mr. Trump said that's why he never drinks.
Drug overdoses and other drug-related deaths claim the lives of about 174 Americas every day, with 115 of those deaths attributable to opioid overdoses.
Legions of users got hooked on prescription opioids and turned to cheaper heroin, which is often laced with potent fentanyl from clandestine labs overseas. Many heroin users don't know the deadly synthetic is in their supply.
The opioid addiction epidemic is largely responsible for lowering life expectancy rates in the U.S. for the past two years. It exceeds the annual death toll from things like car crashes and breast cancer, and estimates suggest it is claiming more Americans that HIV/AIDs did at the height of that epidemic.
"This is why this White House calls this 'the crisis next door,'" Ms. Conway said.
The White House Office of National Drug Control Policy (ONDCP) developed the campaign with the Ad Council and the Truth Initiative.
The website opioids.thetruth.com included information about opioids, the epidemic and drug treatment.
The White House cited data that suggests young people are especially susceptible to opioid misuse:
- More than two-thirds of people in drug treatment for opioids reported their first use of opioids (other than heroin) by age 25.
- In 2016, three-quarters of drug-related overdoses among those aged 15 to 24 were opioid-related.
- Teens in 2016 (aged 15-19) were more than twice as likely to die due to a drug overdose as they were 17 years earlier.
The Centers for Disease Control and Prevention did pilot a separate batch of opioids ads last year in select markets, known as the Rx Awareness Campaign, though the White House said those were geared toward the medical community and patients of all ages.
"This goes right to the public," Ms. Conway said.
The administration said its media partners, including NBC Universal and Vice, will air the ads in a way that "gets to those who need it most."

President Donald Trump may invite North Korean leader Kim Jong-Un to his resort in Palm Beach, Florida, for a hopefully friendly post-summit get-together, Bloomberg reports.
Next week, the president is expected to meet with Jong-Un in Singapore for a highly anticipated summit to discuss North Korea's hopeful denuclearization.
Officials say that Trump is ready to walk out of the meeting if it does not go well. If it does go well, however, he is willing to invite the Korean dictator to his Mar-a-Lago resort.
As Kellyanne Conway said there may be several meetings before any action takes place. As she told reporters, "There could be more than one meeting - more that one conversation."
Though no summit schedule has been released to the public, the meeting is set to happen at the Capella Hotel at 9:00 a.m. on June 12 and last for two days.

If Roseanne's (a private citizen) tweet was unacceptable than how Michelle Wolf treated Press Secretary Sarah Sanders, forget the comments about Kellyanne Conway, were certainly beyond the pale. Following a week marked by damaging leaks and intense media scrutiny, rattled White House communications staffers have been told in closed-door meetings that a major purge is likely coming soon, Fox News has learned.
Many in the White House blame Chief of Staff John Kelly and Trump adviser Kellyanne Conway for failing to apologize for leaked comments made by communications aide Kelly Sadler about Sen. John McCain, four White House sources told Fox News.
Sadler was overheard talking about the Arizona Republican's opposition to Trump's pick to lead the CIA, Gina Haspel, saying that his opinion is irrelevant because "he's dying anyway." The comment came during a meeting of about two dozen White House communications staffers on Thursday morning.
The 81-year-old McCain was diagnosed in July with glioblastoma, an aggressive form of brain cancer.
The remark led to widespread criticism after it was reported last week, but no immediate public apology from Sadler or the White House – a blunder, according to some in the White House, that has allowed the controversy to fester for days. Sadler has called McCain's daughter, Meghan, to apologize.
The warnings about an imminent communications department purge were delivered by top officials, including Chief of Staff John Kelly and Trump adviser Kellyanne Conway, Fox News has confirmed.
Junior communications staffers nervous, scared, and disheartened after hearing about the possible shakeup coming soon, sources told Fox News.
Some in the White House tell Fox News that they believe administration bigwigs like Conway are in fact some of the worst leakers, leading junior staffers in the communications department to feel the warnings of an impending purge are unfair.

The husband of White House counselor Kellyanne Conway took a veiled shot at President Trump following revelations the president repaid his longtime attorney, Michael Cohen, for the $130,000 given to former adult film actress Stormy Daniels.
George Conway, a lawyer who removed his name from consideration for a top Justice Department post, tweeted Thursday a link to the Federal Election Commission's web page for handling personal loans from a candidate for federal office.
Conway included in his tweet a screenshot from the page, which explained what is not considered the candidate's personal funds.
"If any person, including a relative or friend of the candidate, gives or loans the candidate money 'for the purpose of influencing any election for federal office,' the funds are not considered personal funds of the candidate even if they are given to the candidate directly. Instead, the gift or loan is considered a contribution from the donor to the campaign, subject to the per-election limit and reportable by the campaign. This is true even if the candidate uses the funds for personal living expenses while campaigning," the passage highlighted by Conway states.

President Trump painted former FBI director James Comey on Friday as a " LIAR & LEAKER" - hours after reports that he plans to pardon former George W. Bush administration aide I. Lewis (Scooter) Libby for committing those very crimes.
Libby, a close associate of Vice President Dick Cheney, was convicted in 2007 of obstructing justice, perjury and lying to the FBI.
He was set to serve 30 months in jail, but Bush commuted his sentence.
Libby was a central figure in the leaking of covert CIA agent Valerie Plame's identity.
Comey - at the time was serving as deputy attorney general - was the one who appointed a special prosecutor in the Plame case.
White House counselor Kellyanne Conway on Friday declined to confirm Trump's plans for a pardon. Still, she said, "many people think that Scooter Libby was the victim of a special counsel gone amok." Asked if a pardon was about Comey, Conway said no.

Trump fired Comey last year, setting up Mueller's appointment as special counsel.
Comey describes Trump as unethical and "untethered to truth" a highly critical book set to be released next week.
Trump responded Friday by tweeting that Comey is an "untruthful slime ball" who should be prosecuted for leaking classified information.
"It was my great honor to fire him," he added.
The White House has denied Trump ever encouraged Comey to end an investigation into former White House national security adviser Michael Flynn, an encounter Comey memorialized in private notes that he later described in testimony before Congress.
Trump has also accused Comey of leaking information by authorizing a friend to shared details of the discussion about Flynn with the media.

The Libby pardon comes as Mueller moves closer to Trump's inner circle and the President's personal lawyer's office was raided by the FBI.
Mueller is reportedly looking at possible obstruction of justice by Trump and whether anyone on his campaign coordinated with Russia to influence the 2016 election.
Plame, meanwhile, told MSNBC that the pardon said more about the President and those around him than her or Libby.
"It's not about me, it's absolutely not about (Scooter) Libby, it's about Donald Trump and his future," she said. "It's very clear that this is a message he is sending that you can commit crimes against national security and you will be pardoned."
"The message being sent is, you can commit perjury and I will pardon you if it protects me and I deem that you are loyal to me," she added.

Brzezinski was born in New York City, the daughter of Polish-born foreign policy expert and former National Security Advisor Zbigniew Brzezinski[5] and Swiss-born sculptor Emilie Anna Bene?ová. Her mother, of Czech descent, is a grandniece of Czechoslovakia's former president Edvard Bene?. Her father was teaching at Columbia University when she was born; the family moved to McLean, Virginia, near Washington, D.C., in late 1976, when Zbigniew was named National Security Advisor by newly elected President Jimmy Carter. Her brother, Mark Brzezinski, is an American diplomat and was the United States Ambassador to Sweden from 2011 to 2015. Her second brother is military expert Ian Brzezinski. She is a first cousin of the author Matthew Brzezinski.
Brzezinski attended the Madeira School and then enrolled at Georgetown University. During her junior year, she transferred to Williams College in Williamstown, Massachusetts,[5] and graduated with a Bachelor of Arts degree in English in 1989.
She returned to CBS News as an under desk correspondent in September 2001, a move that thrust her into the limelight as a principal "Ground Zero" reporter for the September 11, 2001 attacks. Brzezinski was broadcasting live from the scene when the South Tower collapsed. In her last position at CBS News, Brzezinski served as a CBS News correspondent, substitute anchor, and segment anchor for breaking news segments and routine updates. During this period she became an occasional contributor to CBS Sunday Morning and "60 Minutes." She was subsequently fired by CBS.
The 2016 Democratic National Committee email leak revealed that Debbie Wasserman Schultz, chairperson of the Democratic National Committee, had emailed Chuck Todd, the Political Director of NBC News and host of Meet the Press, to demand that he "stop" Brzezinski from criticizing the DNC's treatment of Bernie Sanders.[11] In December 2016, after Clinton had lost, Brzezinski suggested the Clinton campaign had tried to silence her by calling executives at NBC and telling them she "needed to be pulled off the air".[12]
On February 15, 2017, Brzezinski banned Trump spokesperson Kellyanne Conway from future appearances on her show. Brzezinski said, "We know for a fact that [Conway] tries to book herself on this show. I won't do it. Because I don't believe in fake news, or information that is not true… every time I've ever seen her on television, something's askew, off or incorrect".[13] Her co-host Joe Scarborough said the decision to ban Conway from future appearances was based on her being "out of the loop" and "in none of the key meetings". "She's not briefed. She's just saying things just to get in front of the TV to prove her relevance".[13]
During the 2016 presidential campaign, then-presidential candidate Donald Trump tweeted several times his disdain for both Brzezinski and Scarborough.[18] In March 2017, Brzezinski called Trump's presidency "fake and failed", and soon thereafter Trump unfollowed Brzezinski and Scarborough on Twitter.[19]
In late June 2017, Brzezinski was again the target of Trump's tweets in which he called her "low I.Q. Crazy Mika" and asserted that she was "bleeding badly from a face-lift".[20][21][22] Brzezinski and Scarborough then accused the White House of threatening to blackmail them with an exposé in a tabloid magazine unless the pair apologized publicly to the President.[23]
