'Real Justice Department' veteran emerges as Mueller's top courtroom adversary
A former federal prosecutor has emerged as special counsel Robert Mueller's most persistent courtroom critic.
It's not Rudolph W. Giuliani, a former U.S. attorney and now President Trump's ubiquitous defender, or any of cable TV's prosecutors-turned-pundits.
He is Eric A. Dubelier, a litigator for the Reed Smith law firm who knows international law and the D.C. playing field. He served eight years prosecuting cases as a Justice Department assistant U.S. attorney in Washington. He refers to his former employer as "the real Justice Department," implying that Mr. Mueller's team is something less.
His biting remarks have come in months of court filings and oral arguments. Mr. Dubelier has depicted Mr. Mueller as a rogue prosecutor willfully ignoring Justice Department guidelines.
He has accused Mr. Mueller of creating a "make-believe crime" against his Russian client, Concord Management and Consulting, which is accused of funding a troll farm that interfered in the 2016 election.
So far, the federal judge presiding over the case has sided with Mr. Mueller.
Mr. Dubelier charges that the Mueller team violated the confidentially of Concord's counter evidence while hiding documents Concord needs for its defense. The prosecutor wants to "whisper secrets to the judge," Mr. Dubelier says, as Mr. Mueller is calculating the "short-term political value of a conviction" and not worrying about an appeals court defeat years later.
An example: In a Dec. 20 motion, Mr. Dubelier resurrected a botched case spearheaded by Mr. Mueller's top prosecutor, andrew weissmann.
Mr. weissmann headed the Justice Department's Enron task force nearly two decades ago. He won a conviction against the accounting firm Arthur Andersen for shredding the defunct energy firm's financial documents.
Years later, the U.S. Supreme Court unanimously reversed the conviction. The 2005 decision effectively said that Andersen, by then out of business and its 28,000 employees gone, hadn't committed a crime.
"Mr. Dubelier is exactly right on Mr. Mueller's motives and tactics," said Sidney Powell, whose book "License to Lie" exposes years of Justice Department scandals. "His lieutenant weissmann is the poster boy for prosecutorial misconduct and has no regard for the facts or the law. He will make up whatever he wants to win, and the entire like-minded team views as an accomplishment everyone whose life they destroy in pursuit of their objective."

In November 2016, according to the filing, McCain sent Kramer, a director at the McCain Institute for International Leadership, to London to meet with Steele.
McCain had learned from Sir andrew Wood, the former British Ambassador to Russia, that Steele had collected damaging information about Trump, according to the filing. Wood was an informal adviser to Orbis, which was retained by Fusion GPS, the firm behind the dossier. Fox News previously reported on Wood's involvement.
later obtained copies of the dossier from Glenn Simpson, the head of Fusion GPS, the filing states. Kramer then met with Buzzfeed reporter Ken Bensinger on Dec. 29, 2016 at the McCain Institute.
There, "Kramer reviewed with Bensinger what he knew about the dossier and explained that he took the allegations seriously." Then, Kramer showed Bensinger the dossier and purportedly informed him that "some of the information was unverified."
Steele shared a report from the dossier written on Dec. 13 with an unnamed British security official, GOP Illinois Rep. Adam Kinzinger, R-Ill., Senior Director for Russian Affairs at the National Security Council (NSC) Celeste Wallender, and House Speaker Paul Ryan's chief of staff, John Burks.
However, Fox News reported in August that embattled Justice Department official Bruce Ohr had contact in 2016 with then-colleague andrew weissmann, now a top deputy to Special Counsel Robert Mueller, as well as other senior FBI officials about the dossier and the people behind it.
Ohr's network of contacts on the dossier included: anti-Trump former FBI agent Peter Strzok; former FBI lawyer Lisa Page; former deputy director andrew McCabe; weissmann and at least one other DOJ official; and a current FBI agent who worked with Strzok on the Russia case.
In a report last week, the Justice Department Inspector General revealed that government-issued phones belonging to Strzok and Page were wiped completely soon after they were terminated from the Mueller probe over anti-Trump bias.

This could be YUGE! Taking weissmann out will strike a massive blow to Mueller and his witch hunt. Imprisoning weissmann for his crimes would be frosting on the cake. The shit he pulled at Enron should put him away for life. At least one of the wrongfully imprisoned innocents died while in prison. weissmann needs to do the same, along with Mueller, Loretta Lynch, and his entire team of co-conspirators.

The following day, the AP published an exposé on Paul Manafort's relationship with Ukraine officials.

Former Donald Trump campaign chair Paul Manafort pleaded guilty to two federal criminal charges in a Washington D.C. courthouse Friday - and is now cooperating with federal prosecutors, according to the latest high-stakes turn in the case.
The stunning development that Manafort will assist prosecutors who went after him on a raft of money laundering and tax charges follows a series of earlier indications that Manafort would not cooperate with special counsel Robert Mueller.
His cooperation, depending on the extent of it, could provide prosecutors with a valuable tool as they forge ahead with the Russia probe.
The existence of a cooperation was stated in court by a member of Mueller's team, andrew weissmann, CNN reported Friday.
President Donald Trump has railed against the Robert Mueller probe as a 'witch hunt' and has hailed Manafort as 'brave' for refusing to make a deal.
White House press secretary Sarah Sanders issued a statement following the bombshell development in court.
'This had absolutely nothing to do with the President or his victorious 2016 Presidential campaign. It is totally unrelated,' Sanders said.
A cooperation agreement would bind Manafort to answering questions from prosecutors about the gamut of questions about what he knows as they pursue their probe of Russian election interference in the elections and connections between President Donald Trump's team and Russians.
Manafort attended the infamous Trump Tower meeting with Russian in June of 2016 that got set up after a British music publicist reached out to Donald Trump Jr. after getting an offer of dirt on Hillary Clinton.
Manafort also will be required to forfeit assets as part of the plea. Prosecutors say he deprived taxpayers of $15 million and laundered $30 million in assets. Manafort used overseas income to purchase homes in the U.S., then took out millions in bank loans to fund purchases here without declaring the money as income.
The feds will seize four of Manafort's homes and some of his funds, the New York Times reported.
Manafort has homes in Brooklyn, SoHo, Chinatown, a Trump Tower condo, a place in the Hamptons on Long island, a home in Alexandria Virginia, and a home in Florida.

Specifically, the text says: "I had literally just gone to find this phone to tell you I want to talk to you about media leak strategy with DOJ before you go."April 12, 2017: Peter Strzok congratulates Lisa Page on a job well done while referring to two derogatory articles about Carter Page. In the text, Strzok warns Page two articles are coming out, one which is "worse" than the other about Lisa's "namesake"." Strzok added: "Well done, Page."
The letter notes the troubling nature of the text messages. Former Deputy Director andrew McCabe was fired by Attorney General Jeff Sessions after a scathing report from the DOJ Inspector General Michael Horowitz's investigation charging McCabe with lying to investigators and leaking to the press. Last week, the DOJ announced that McCabe is currently under a grand jury investigation.

"In light of the new information, our task force is requesting to review text messages, emails, and written communication form FBI and DOJ officials Stu Evans, Mike Kortan, and Joe Pientka between June 2016 to June 2017," said Meadows in the letter. "To be clear, we are not suggesting wrongdoing on the part of Evans, Kortan, and Pientka- and, in fact, previously reviewed documents suggest that some of these individuals may share the committees' same concerns."
"However, these additional documents, with an emphasis on communication between the aforementioned individuals and Peter Strzok, andrew McCabe, Lisa Page, Bruce Ohr, and andrew weissmann, would provide critical insight into the backdrop of the Russia investigation."

The AP meeting arranged by weissmann came to light in a letter sent to Justice Department Deputy Attorney General Rod Rosenstein from House Intelligence Committee Chairman Devin Nunes, R-CA, late last year, requesting specific FBI and DOJ documentation related to the controversial Fusion GPS dossier that alleged collusion between the Trump campaign and Russia.
That meeting with the AP was attended by three different litigating offices. Two employees from the U.S. Justice Department and the other representative was from the U.S. Attorney's office, according to the sources. FBI agents also attended the meeting, law enforcement sources confirmed.
According to sources, the FBI agents in attendance filed a complaint about weissmann and the meeting with the DOJ fearing his arrangement of such a meeting would hurt the investigation.

Special counsel Robert Mueller is bolstering his team of U.S. investigators probing possible collusion between the Trump campaign and Russia, adding a top Justice Department official who's been overseeing corporate fraud and foreign-bribery investigations, as well as a former law-firm colleague, according to people familiar with the matter.
Justice Department fraud chief andrew weissmann is the most senior government lawyer to join Mueller, the former Federal Bureau of Investigation director who became special counsel on May 17, said two people, who asked not to be named discussing a personnel matter that hasn't been made public.

weissmann and Rhee join a growing team that includes Peter Carr, a veteran spokesman for the Justice Department who will deal with the news media, and two former Wilmer partners, Aaron Zebley and James Quarles.
As the head of the fraud section in the Obama administration, weissmann's specialties have included overseeing investigations into corporate wrongdoing and foreign corruption – including probes into Volkswagen AG over diesel-cheating, global banks over market manipulation and Brazil's state-owned oil company Petrobras over corrupt payments. He also started a pilot program that offered companies incentives to self-report possible violations of the Foreign Corrupt Practices Act, which prohibits bribing foreign officials.
Special Investigations
weissmann previously worked for Mueller as the FBI's general counsel from 2011 to 2013. He also has experience with special investigations, having worked on and later managed the Enron task force during the George W. Bush administration.
Rhee, for the past six years, has advised Wilmer clients under government investigation. She previously worked for two years as a deputy assistant attorney general in the Justice Department's Office of Legal Counsel advising the White House and the attorney general on executive power and national-security issues. Rhee initially joined Wilmer in 2006. Before that, she was an assistant U.S. attorney in Washington.
weissmann's move leaves another senior leadership post open at the Justice Department, which still awaits appointments from Trump to lead its criminal and civil divisions. weissmann was brought on in 2015 to run the fraud section under Leslie Caldwell, assistant attorney general for the criminal division during the Obama administration, whom he previously worked with on the Enron task force.
Sandra Moser, weissmann's deputy and an 11-year veteran of the Justice Department, will take over the fraud section as its acting chief until a permanent replacement is named. Moser has been a supervisor in the section for the past four years
weissmann didn't immediately respond to messages seeking comment. Rhee couldn't immediately be reached for comment.
Carr, the Mueller spokesman, and Wyn Hornbuckle, a spokesman for the Justice Department, declined to comment

Mueller team files complaint against Manafort trial judge over latest reprimand
After days of being dressed down by the judge overseeing the Paul Manafort case, federal prosecutors sought Thursday to put their foot down – filing a motion complaining that Judge T.S. Ellis III had unfairly admonished them in front of the jury.
Ellis has memorably and repeatedly criticized Special Counsel Robert Mueller's team during the trial for the former Trump campaign chairman. On Wednesday, Ellis ripped into prosecutors for letting a witness, IRS Agent Michael Welsh, sit in the courtroom before his testimony.
But in a five-page motion filed Thursday, Mueller deputy andrew weissmann and other attorneys on the team claimed Ellis had actually granted permission earlier in the trial for the witness to remain in the room during proceedings.
"The court's reprimand of government counsel suggested to the jury-incorrectly-that the government had acted improperly and in contravention of court rules," the prosecutors wrote. "This prejudice should be cured."
Ellis responded by expressing regret in court Thursday.
"This robe doesn't make me anything other than human," Ellis said.
Referencing his earlier reprimand, Ellis said Thursday: "Any criticism of counsel should be put aside."
The truce between the judge and prosecutors, though, did not last long.
Hours later, when prosecutors tried to introduce an exhibit that was dozens of pages long, Ellis interjected: "There might be some kind soul on the jury who thinks they need to leaf through all this stuff – and it isn't true."
The Mueller team relented and only entered 11 pages into evidence.
Ellis has a reputation for making colorful comments - and being tough on the prosecution.
On Wednesday, Ellis explained that he would not ask the defense to reveal as much information as he has demanded from the prosecution because "it's sort of like poker – you don't have to show your hand until you're called."
"Something like that, I'm not a poker player," Ellis said.

Associated Press reporters might have provided the tip that led the FBI to search a storage unit used by former Trump campaign manager Paul Manafort, an FBI agent said in federal court on Friday.
Jeff Pfeiffer, the FBI agent, said in a pretrial hearing that AP reporters asked about the storage unit during an April 2017 meeting with Department of Justice attorneys and FBI agents to discuss an investigation into Manafort.
Manafort, who faces charges of tax evasion and bank fraud related to his Ukraine lobbying work, has challenged the search warrant used to access his storage unit. He has also accused DOJ lawyer andrew weissmann, a member of the special counsel's team, of leaking information about his case to reporters. weissmann was at the April 2017 meeting with the AP. Pfeiffer said the DOJ met with AP reporters in order to gain information about the wire service's investigation into Manafort, according to Politico, which had a reporter present at Friday's pretrial hearing. The agency's attorneys offered no information in return, Pfeiffer said.
"Generally, no comment," was the DOJ's response to questions posed by the AP, Pfeiffer testified.
Pfeiffer and other FBI agents took part in a May 2017 search of Manafort's storage unit. An assistant to the longtime Republican consultant granted them access to the facility.
Manafort's trial in Alexandria, Virginia, is scheduled to start on July 25. He has also been indicted in Washington, D.C., on similar charges related to his consulting work. That trial is expected to begin in September.
So far, the special counsel's office has yet to produce evidence about Manafort's activities as a member of the Trump campaign. The indictments center on work that Manafort did from 2005 through 2014 on behalf of a Ukrainian political party affiliated with former Ukrainian president Viktor Yanukovych.

Special counsel Robert Mueller's team wants to use a written questionnaire to gauge whether "widespread media attention" has biased potential jurors for former Trump campaign chairman Paul Manafort's upcoming criminal trial.
The lead Russia investigator filed an eight-page motion on Thursday raising concerns about how both his overall probe into Trump's 2016 presidential campaign and Moscow election meddling, as well as the Manafort case specifically, had generated extensive media coverage - not all of it correct - that could taint the jury pool. Manafort is facing a series of financial fraud, tax and lobbying charges in cases spiraling out of Mueller's broader probe.
"The reporting, at times inaccurately, comments on the nature of the evidence collected in the case or activities of the parties," andrew weissmann, one of Mueller's lead prosecutors, wrote, noting it had found thousands of references to the investigation in its search of newspaper, television and radio coverage.

Several court filings indicate that when lawyers from Mueller's office appeared in federal court in Alexandria earlier this year, they did so not only as representatives of Mueller's office but as special assistant United States attorneys (SAUSAs) attached to the United States attorney's office there.
One lawyer who has studied the use of SAUSAs said the granting of that status to lawyers on Mueller's team theoretically gives them the authority to pursue matters that aren't within the special counsel's mandate.
