Q Research General #5660 Geofffrey Berman Bringing the Hammer Down? Edition
Thanks baker for putting Berman in the notables. I've been trying to get the attention of anons for a while, but they seem to want to gloss over…
I emplore anon to do a dig on Berman. Much more. Kansas payday lender, with ties to Florida (DWS) just charged in Manhattan (because of connections to CF?)
First ever bank secrecy act charge
https://www.justice.gov/usao-sdny/pr/manhattan-us-attorney-announces-bank-secrecy-act-charges-against-kansas-broker-dealer
Rosenstein stepped over Berman to bring the Cohen raid. Berman had to recuse himself because he worked on the Trump campaign.

Could be because Trump interviewed Berman for the job. Apparently it is highly unusual for Presidents to interview U.S. Attorneys:
"I never heard of a president interviewing a US attorney candidate," Richard Painter, a University of Minnesota law professor who served as Bush's chief ethics lawyer, told Business Insider.
Politico reported this week that Trump interviewed candidates for the Southern and Eastern District of New York, citing sources.
Trump reportedly interviewed Geoffrey Berman, who works at the same law firm as former New York City Mayor Rudy Giuliani, for the vacancy in the Southern District of New York, the spot vacated by former US Attorney Preet Bharara. In the Eastern District of New York, Trump interviewed Ed McNally, who works at the law firm headed by Marc Kasowitz, Trump's former top lawyer in handling special counsel Robert Mueller's investigation.

With No Nomination From Trump, Judges Choose U.S. Attorney for Manhattan
Exercising a seldom-used power, the judges of the Federal District Court in Manhattan voted unanimously on Wednesday to appoint Geoffrey S. Berman as the United States attorney for the Southern District of New York, according to a court statement.
Mr. Berman was appointed interim United States attorney in January, and his 120-day term was due to expire next week. With no one yet nominated by President Trump for the Southern District position, the judges acted to fill it with Mr. Berman.
Under federal law, he will now serve until the Senate confirms a nominee by President Trump, whose administration has been slow to fill many posts in the executive and judicial branches.
About 40 judges were eligible to vote on Mr. Berman's appointment, according to a court list. Many of the judges had once served as Southern District prosecutors, as had Mr. Berman, who worked in the office from 1990 to 1994.

Moar on Berman.
He just unsealed indictments on 19 people trafficking children in New York.
What is not being told, is it was a Jewish operation…
The defendants are accused of recruiting at least 15 minor girls in the child welfare system, including at least nine girls at Hawthorne Cedar Knolls in Mount Pleasant, for prostitution.
"Children in the child welfare system are among the most vulnerable in our society," U.S. Attorney Geoffrey Berman said in a statement. "The defendants and their conspirators callously recruited girls as young as 13 from a residential treatment facility for at-risk youth then sexually trafficked and prostituted them for financial profit."
The Hawthorne Cedar Knolls residential treatment center for troubled youths was closed this year by its operator, the Jewish Board of Family and Children's Services, after years of controversy. The agency still runs a special needs school and two therapeutic residences for adolescents and young adults
A spokeswoman for the Jewish Board declined to discuss details of the sex trafficking case.

She ain't heavy, she's my lover.
Former Gov. Eliot Spitzer used to smuggle his Russian-escort mistress into the luxury Upper East Side home he shared with his wife - by stuffing her inside a piece of luggage, she told The Post.
"He used to sneak me into his Fifth Avenue apartment in a black suitcase . . . when his wife was away,'' Svetlana Travis Zakharova told The Post in an exclusive interview.
"My knees would be up by my face. When the doorman would ask if he could help, Eliot would say, 'No, thanks.' "
Zakharova revealed the sleazeball sneak tactic - which she said the pair pulled off about 15 times at Eliot and Silda Spitzer's home - as her lawyer prepared a new push to put the disgraced former pol behind bars.
The Russian sexpot first hit the headlines in early 2016 when she accused Spitzer of choking her during a sex-session-gone-awry at The Plaza hotel in Midtown.
Now, Zakharova's Queens lawyer, Joseph Murray, is asking Manhattan US Attorney Geoffrey Berman to investigate Spitzer for alleged "improprieties" in his efforts to evade prosecution.
Zakharova recently told The Post that when she met the then-married multimillionaire in 2010, he was as cocky as ever - but still a bum underneath it all.
"When I first met him, he bragged how rich he was. But I didn't believe him because he had holes in his underwear,'' she said.
Zakharova, now 28, said Spitzer would whine about another girlfriend and his wife when they met up for their anything-goes romps.
"He told me about problems with his wife. She complained about his drinking. She bought a dog without telling him," Zakharova said.
But Spitzer, 59, got back at his spouse by not only going outside their marriage for sex, but by breaking Silda's cardinal rule for their upstate estate: No one but family allowed, the ex-lover said.
"He used to take me upstate to the farm,'' Zakharova said. "He cooked for me, omelets, and he would put a potato in the microwave.

It's all connected. Geoffrey Berman is now SDNY AG, appointed by Jeff Sessions….
Preet Bharara used to be in that position, and the SDNY AG's office opened an investigation into the CF, but Loretta Lynch blocked it.
Rudy Giuliani was also the SDNY AG at one time.
So, now we go back and review Q post 1370
Most likely Preet was helping block or muddle the investigation into the CF, Weiner Laptop, and the Child Trafficking referred to in the IG report.

Trump's Ex-Lawyer Didn't Violate Campaign Finance Laws, and Neither Did the President
President Donald Trump's former attorney, Michael Cohen, may have been convinced by the Office of the U.S. Attorney for the Southern District of New York to plead guilty to a supposed violation of campaign finance law, but that doesn't mean that what happened is actually a federal crime.
In fact, neither the Federal Election Commission-which is the independent agency tasked with enforcing the Federal Election Campaign Act-nor its former commissioners would likely agree with the overaggressive view that the Southern District is taking. Indeed, the Southern District's aggressive stance on this issue might have violated the Justice Department's own policy.
Robert Khuzami, the acting U.S. attorney standing in for Geoffrey Berman, who has recused himself from the Cohen case, says in the government's sentencing memorandum that Cohen committed a campaign finance violation by arranging payments from corporations to two women-Woman-1 and Woman-2 (Karen McDougal and Stormy Daniels, respectively), who claimed they had affairs with Trump-in order to buy their silence. Cohen eventually invoiced the Trump Organization for the Daniels payment.
Khuzami asserts these were illegal corporate contributions to the Trump campaign because they were made with "the intent to influence the 2016 presidential election." Thus, he claims, they were campaign-related expenses and all of the rules governing federal campaigns apply to the payments.
But there are numerous problems with Khuzami's claim.

BOMBSHELL: Evidence of 9/11 Controlled Demolition to go before Special Grand Jury
In what can be described as a monumental step forward in the relentless pursuit of 9/11 truth, a United States Attorney has agreed to comply with federal law requiring submission to a Special Grand Jury of evidence that explosives were used to bring down the World Trade Centers.
The Lawyers' Committee for 9/11 Inquiry successfully submitted a petition to the federal government demanding that the U.S. Attorney present to a Special Grand Jury extensive evidence of yet-to-be-prosecuted federal crimes relating to the destruction of three World Trade Center Towers on 9/11 (WTC1, WTC2 and WTC7).
After waiting months for the reply, the U.S. Attorney responded in a letter, noting that they will comply with the law.
"We have received and reviewed The Lawyers' Committee for 9/11 Inquiry, Inc.'s submissions of April 10 and July 30, 2018. We will comply with the provisions of 18 U.S.C. § 3332 as they relate to your submissions," U.S. Attorney Geoffrey Berman stated.
This letter from the U.S. Attorney was signed by Michael Ferrara and Ilan Graff, Chiefs, Terrorism and International Narcotics Unit.
As the Lawyers' Committee for 9/11 Committee points out, the U.S. Attorney's letter does not spell out the steps that will be taken to comply, but 18 U.S.C. § 3332 is clear as to what these steps must be. This law states: "[a]ny such [United States] attorney receiving information concerning such an alleged offense from any other person shall, if requested by such other person, inform the [Special] grand jury of such alleged offense, the identity of such other person, and such attorney's action or recommendation." This law also states that "(a) It shall be the duty of each such [special] grand jury impaneled within any judicial district to inquire into offenses against the criminal laws of the United States alleged to have been committed within that district."
To illustrate just how historic this response is, below is a summary of the information presented to the federal government via the petition. It does not mince words and details the overwhelming evidence indicating the use of explosives in bringing down the twin towers as well as tower 7.
The Lawyers' Committee's April 10th 52-page original Petition was accompanied by 57 exhibits and presented extensive evidence that explosives were used to destroy three WTC buildings. That evidence included independent scientific laboratory analysis of WTC dust samples showing the presence of high-tech explosives and/or incendiaries; numerous first-hand reports by First Responders of explosions at the WTC on 9/11; expert analysis of seismic evidence that explosions occurred at the WTC towers on 9/11 prior to the airplane impacts and prior to the building collapses; and expert analysis by architects, engineers, and scientists concluding that the rapid onset symmetrical near-free-fall acceleration collapse of three WTC high rise buildings on 9/11 exhibited the key characteristics of controlled demolition. The Lawyers' Committee's July 30th Amended Petition addresses several additional federal crimes beyond the federal bombing crime addressed in the original Petition. The Lawyers' Committee concluded in the petitions that explosive and incendiary devices preplaced at the WTC were detonated causing the complete collapse of the WTC Twin Towers on 9/11 and increasing the tragic loss of life.
Attorney Mick Harrison, Litigation Director, stated: "The failure of our government to diligently investigate this disturbing evidence has contributed to the erosion of trust in our institutions. The Lawyers' Committee felt it was our duty as public citizens to submit this evidence to the U.S. Attorney for submission to the Special Grand Jury."

FIRST DOJ INDICTMENTS UNSEALED: Clinton Foundation-Connected Bank "Mossack Fonseca" Tied To Money Laundering
WASHINGTON, DC - As reported by Courthouse News Service, Federal prosecutors announced charges this Tuesday against four men connected to the law firm "Mossack Fonseca", which has extensive ties with the Clinton Foundation.
The charges, which include Conspiracy to Defraud the United States, Conspiracy to Commit Wire Fraud, Conspiracy to Commit Tax Evasion, Wire Fraud, and Money Laundering Conspiracy, come merely three years after the leak of the Panama Papers by the ICIJ, and pushed heavily by Wikileaks. The papers were received by the German newspaper Suddeutsche Zeitung in 2015 from an anonymous source.
The charges line up with several of the sealed indictments requesting wiretaps, PRTT orders, and search warrants which were leaked by the DOJ recently and reported on by the Daily Crusader (see our full report on the DOJ's leaked search warrant indictments: PART ONE HERE and PART TWO HERE)
This shows that Clinton Foundation may well be very close to being rolled up; these charges, while very serious, still do not explain some of the leaked PRTT/wiretap orders, such as the National Security orders, the drug trafficking orders, or the orders related to child trafficking or providing aid to foreign terrorist organizations.
The charges filed Tuesday lay out a scheme by which participants would hide their assets in foreign tax havens away from the prying eyes of US and other sovereign nations taxation authorities, presumably to avoid paying taxes and possibly to have assets available should they ever need to flee their respective home countries for their alleged treason.
Authorities have successfully arrested three of the four men; Dirk Brauer, a 54-year-old German investment advisor for Mossfon Asset Management; Richard Gaffey, a 74-year-old U.S. accountant; and Harald Joachim von der Goltz, an 81-year-old German-born client. Mossack Fonseca attorney Ramses Owens, a 50-year-old from Panama, remains at large.
The charges were all levied by U.S. Attorney Geoffrey Berman in the Southern District of New York, which FBIAnon heavily suggested in 2016 would be where the Clinton Foundation would be taken down.

In a statement, Berman said: "For decades, the defendants, employees and a client of global law firm Mossack Fonseca, allegedly shuffled millions of dollars through off-shore accounts and created shell companies to hide fortunes. In fact, as alleged, they had a playbook to repatriate un-taxed money into the U.S. banking system. Now, their international tax scheme is over, and these defendants face years in prison for their crimes."
One of the clients, listed as "Client 3" began cooperating with the DOJ, using voluntary wiretaps and by meeeting with undercover agents in America and overseas, in January 2017, heavily lending credence to Daily Crusader's theory (see our full report on the DOJ's leaked search warrant indictments: PART ONE HERE and PART TWO HERE) that some of the Cabal crimes being handled by DOJ were necessarily ordered investigated by the President, due to the nature of their "50 USC" statute violations.
Eleven charges were outlined in the indictment against the four men.
Clinton Foundation-connected associates which are related to Mossack Fonseca include Gabrielle Fialkoff, finance director for Hillary Clinton's first campaign for the U.S. Senate; Frank Giustra, a Canadian mining magnate who has traveled the globe with Bill Clinton; a member of the Chagoury family, which pledged $1 billion in projects to the Clinton Global Initiative; and Chinese billionaire Ng Lap Seng, who was at the center of a Democratic fund-raising scandal when Bill Clinton was president. Also using the Panamanian law firm was the company founded by the late billionaire investor Marc Rich, an international fugitive when Bill Clinton pardoned him in the final hours of his presidency.
Some of the most consistently reliable news sources, such as RT, have been reporting about the connection between the Clinton Foundation and Mossack Fonseca since at

Ex-Valeant, Philidor executives get prison for fraud
A former executive at Valeant Pharmaceuticals International Inc and the former head of a start-up mail-order pharmacy were sentenced to one year in prison on Tuesday after being convicted of defrauding the drugmaker through a secret kickback scheme. Gary Tanner, 41, the former Valeant executive, and Andrew Davenport, 50, the former chief executive of Philidor Rx Services LLC, were also ordered to forfeit $9.7 million, representing the alleged kickbacks. The sentences were imposed by U.S. District Judge Loretta Preska in Manhattan. Both defendants had been convicted in May on four charges, including honest services wire fraud and conspiracy to commit money laundering. Prosecutors had recommended prison terms of between 2-1/2 and 10 years for Tanner, and 2-1/2 and eight years for Davenport. The defendants said no prison time was justified. Lawyers for Tanner and Davenport did not immediately respond to requests for comment.
The case was the first criminal prosecution arising from multiple probes into Valeant's business practices, including its ties to the now-defunct Philidor. Those ties began drawing scrutiny in October 2015, when investors learned that Valeant had in 2014 acquired an option to buy Philidor, and was suspected of using it to boost sales. The revelations contributed to a steep fall in Valeant's share price that was compounded by the probes and the Laval, Quebec-based company's heavy debt load. Management was overhauled, and Valeant changed its name to Bausch Health Cos in July, taken from the name of its Bausch & Lomb eye care unit. Tanner had managed Valeant's relationship with Philidor as well as Valeant's "alternative fulfillment" program, through which the drugmaker sought to increase prescriptions for its own drugs instead of generic substitutes.
Prosecutors accused Tanner of steering Valeant business to Philidor, while concealing a $9.7 million kickback from Davenport that came from the roughly $50 million Davenport received when Valeant acquired the option to buy his company. "I deeply regret giving money to Gary Tanner," Davenport told Preska. Prosecutors said that to keep the scheme secret, Tanner often used an email account with the name "Brian Wilson" to communicate with Davenport and sabotage potential business with rival pharmacies. "Tanner was entrusted to manage Valeant's relationship with Davenport's company," U.S. Attorney Geoffrey Berman said in a statement. "Instead, they devised a scheme to pillage Valeant and share the proceeds." The case is U.S. v Tanner et al, U.S. District Court, Southern District of New York, No. 17-cr-00061.

Ladies and gentlemen, please welcome our United States Attorneys.
***
A few months ago, on law day, President Trump explained that in the United States, "we govern ourselves in accordance with the rule of law rather than according to the whims of an elite few or the dictates of collective will. Through law, we have ensured liberty. We should not ... take that success for granted."
The President's words are of central importance to the Department of Justice, because the rule of law in America depends on the character of the people who enforce the law.
All executive branch employees take the same oath. The first clause requires us to "support and defend the constitution of the United States against all enemies, foreign and domestic."
Everyone is familiar with that duty.
But some overlook the final clause: a promise to "well and faithfully discharge the duties of the office on which I am about to enter."
The first obligation is general. It imposes a duty to pursue the national interest over any personal interest. That applies equally to every government employee.
But the final clause is specific. Everyone recites the same words, but the meaning varies. In order to well and faithfully discharge the duties of "the office," you need to understand your unique responsibilities. What is the mandate of your agency; what is the mission of your component; and how do you add value?
You need to know what you stand for.
In 1940, Attorney General Robert Jackson spoke eloquently about what our Department stands for. He said that "the citizen's safety lies in the prosecutor who tempers zeal with human kindness, who seeks truth and not victims, who serves the law and not factional purposes, and who approaches [the] task with humility."
If you follow that advice, you will remain faithful to our mission.
The mission attracted me to work in this Department, but what I treasure most are the people who faithfully carry out the mission.
I am grateful for your service, and I am honored to work with you in the cause of justice.

Former Energy Company Executive Sentenced In Connection With The Bribery Scheme Of Former Executive Deputy Secretary To The Governor Of New York
Geoffrey S. Berman, the United States Attorney for the Southern District of New York, announced that PETER GALBRAITH KELLY JR., a former executive at Competitive Power Ventures ("CPV"), was sentenced to 14 months in prison for defrauding CPV by misrepresenting that the former Executive Deputy Secretary to the Governor, Joseph Percoco, had obtained state ethics approval for his wife to work at CPV. Co-defendants Percoco and Steven Aiello were convicted of charges relating to bribery on March 13, 2018, after an eight-week jury trial. The jury was deadlocked on the charges against KELLY. Joseph Gerardi, who was acquitted of all charges at the trial with Percoco, was convicted of all charges in a related trial earlier this year. KELLY pled guilty on May 11, 2018, to one count of conspiracy to commit wire fraud before U.S. District Judge Valerie E. Caproni, who imposed today's sentence.
U.S. Attorney Geoffrey Berman said: "Braith Kelly admitted to giving the spouse of one of the most powerful men in Albany, Joseph Percoco, a low-show job at his company in order to ingratiate himself and his company with Percoco. Many consider this type of behavior to be 'the way things are done' in government. But our Office does not, and neither does the court."
In imposing today's sentence, Judge Caproni stated: "I hope the sentence will be heard in government affairs offices everywhere...you have to play by the rules."
According to the evidence introduced at trial, other proceedings in this case, and documents previously filed in Manhattan federal court:

Police Arrest Man For Plotting to Blow Himself Up in DC on Election Day 'Over Country's Direction'
Another day, another deranged leftist.
A Rockland County, New York man named Paul Rosenfeld was arrested Wednesday for plotting to blow himself up in Washington D.C. on election day because he was unhappy with the country's direction.
Paul Rosenfeld, 56, wanted to bring attention to his "radical political beliefs," by killing himself on the Nation Mall, according to authorities.
CBS reported:
"As alleged, Paul M. Rosenfeld concocted a twisted plan to draw attention to his political ideology by killing himself on the National Mall in Washington, D.C. risking harm to many others in the process," said U.S. Attorney Geoffrey Berman. "Rosenfeld's alleged plan for an Election Day detonation cut against our democratic principles."
Rosenfeld allegedly supported a political belief called sortition, which advocates for random selection of government officials.
Rosenfeld allegedly bought large quantities black powder over the internet to build a large bomb in his basement, authorities said. He had previously made and tested other small bombs, according to authorities.
When FBI agent searched his home, they found "what appeared to be a functional explosive device weighing approximately 200 pounds."
The bomb was removed from his home and transported to a safe location, officials said.
FBI agents could be seen removing boxes from Rosenfeld's home in Tappan Wednesday.
Rosenfeld was charged with unlawfully manufacturing a destructive device, which carries a maximum sentence of 10 years in prison. He is also charged with interstate transportation and receipt of an explosive, which also has a maximum sentence of 10 years in prison.

Report: De Blasio Blames Media, Michael Bloomberg For His Administration Understating Number Of Kids With Lead Poisoning
On Friday, according to Yoav Gonen, the City Hall Bureau Chief of the New York Post, New York City Mayor Bill de Blasio blamed the media and former New York Mayor Michael Bloomberg for de Blasio's administration consistently understating the number of children living in New York public housing who tested positive for lead poisoning.
The de Blasio administration finally admitted the truth on Thursday, acknowledging that 1,160 children living in public housing had tested positive for lead poisoning since 2012. Last year, the New York City Housing Authority (NYCHA) was accused of failing to perform required lead inspections since 2013 and lying to the federal government about the issue.
On June 11, Geoffrey Berman, the U.S. attorney for the Southern District of New York, said his team had filed a civil complaint and proposed a settlement agreement to the NYCHA. At that time, the city had only acknowledged 19 children were exposed to deteriorating lead paint in their NYCHA apartments between 2010 and 2016.
On June 30, de Blasio's office admitted that up to 820 children had tested positive for elevated levels of lead and that health officials had failed to follow up and inspect their housing. The city recorded 229 kids under 6 who had lead levels between 5 and 10 micrograms in 2012 followed by 184 kids in 2013, 181 in 2014, 112 in 2015, and 114 in 2016.
On July 1, New York City Comptroller Scott Stringer stated he would investigate the Mayor's Office, NYCHA, and the city Departments of Health and of Housing Preservation and Development, commenting, "That they have continued to put children in jeopardy is an outrage ... We must stop these agencies from making one mistake after another." The New York Post reported, "The comptroller also blasted City Hall for only coming clean about the extent of the problem after months of controversy and a $1 billion-plus settlement with the feds over the dangerous and decrepit living conditions provided by NYCHA."
In 2017, de Blasio asserted, "Thank God there has not been harm done to any child because of the mistakes that were made."

Played no role in raid on Cohen's law office and seizure of attorney-client files from Trump's personal attorney.
Monday, the FBI raided Michael Cohen's office. Cohen is Trump's personal attorney.
Now, Geoffrey Berman, the Trump-appointed Interim U.S. Attorney for the Southern District of New York, is recused from the Cohen investigation. Berman's status as a Trump temporary appointee was used to claim that the warrant was not politically motivated.
But now it turns out that Berman had recused himself and had nothing to do with the warrant against Cohen.
SCOOP: ABC News has learned Geoffrey Berman, the U.S. Attorney for the Southern District of New York, is recused from the Michael Cohen investigation. He had no role in raid of Cohen's office. Another recusal that will make @realDonaldTrump unhappy.

Berman was not involved in the decision to raid Cohen's office, according to ABC News:
ABC News has learned that Geoffrey Berman, the U.S. Attorney for the Southern District of New York, is recused from the Michael Cohen investigation.
Two sources familiar with the matter tell ABC News Berman was not involved in the decision to raid Cohen's office because of the recusal.
The recusal was approved by Deputy Attorney General Rod Rosenstein.
The raid of Cohen's handled by others in the office of the U.S. Attorney for the Southern District of New York and approved by a federal judge.
Berman is a Trump appointee with ties to Rudy Giuliani who donated money to the 2016 Trump campaign.

Here's a better explanation
It's what the Dems get for slow walking the nominations!

Brooklyn federal judges have tapped the borough's current U.S. attorney to stay on the job.
The judges formally appointed Richard Donoghue, according to a Thursday announcement.
In January, Attorney General Jeff Sessions picked Donoghue, 50, as the "interim" top federal prosecutor for a jurisdiction that stretches from Brooklyn to Suffolk County. When appointing Donoghue, Sessions also tapped Geoffrey Berman as the Manhattan U.S. Attorney.
Donoghue hasn't been confirmed by the Senate. The vote scraps the "interim" title and keeps him in place until the Senate confirms a nomination from President Trump.

Rudy Giuliani law partner to replace Preet Bharara, noted prosecutor tapped to run Brooklyn's U.S. Attorney's office
A veteran lawyer who works with former mayor Rudy Giuliani will take over the Manhattan U.S. Attorney's office, filling the job Preet Bharara was fired from in March.
Geoffrey Berman was named to lead the high-profile Manhattan office, and a longtime prosecutor, Richard Donoghue, was tapped to run the Brooklyn's U.S. Attorney's office, according to the Justice Department.
The pair were two of the 17 interim U.S. attorneys named Wednesday by Attorney General Jeff Sessions.
"Each has excellent prosecution skills and the temperament necessary to succeed in this critical role-and they have already proven that with a number of accomplishments on behalf of the American people," Sessions said.
Berman, a Manhattan federal prosecutor for four years, is a partner at white shoe lawfirm Greenberg Traurig. Giuliani works there as chairman of its Cybersecurity, Privacy and Crisis Management Practice. Berman reportedly interviewed for the job with President Trump.
Berman also worked as an associate counsel in the Office of Independent Counsel Iran-Contra from 1987 to 1990. While there, he won a tax fraud case against an ex-CIA employee, according to his firm's website.
Donoghue, who spent nearly 12 years in the office he's been tapped to run, is currently a senior vice president and chief litigation lawyer at the computer tech giant CA Technologies.
While at the Brooklyn U.S. Attorney's Office, he rose to become the chief of the criminal division, according to his LinkedIn profile.
Donoghue, a St. John's University School of Law grad, started his career in the U.S. Army's JAG Corps.
A number of other legal heavy-hitters applied for the job, and one of them, Edward McNally, reportedly interviewed with President Trump.
Donoghue would replace Bridget Rohde, the current acting Brooklyn U.S. Attorney.
Rohde took the reins after President Trump dropped the ax on U.S. Attorneys all over the country, including Brooklyn U.S. Attorney Robert Capers and Bharara.

Dershowitz: Mueller 'Laundering Information to Another Prosecutorial Authority'
Alan Dershowitz joined "Hannity" to discuss what he said was a pre-arranged meeting with President Trump and White House officials.
Dershowitz said that he believes Trump will not fire anyone connected to the Mueller probe.
However, he did comment on the fact Trump attorney Michael Cohen's properties were raided by federal agents.
The office of the U.S. Attorney for the Southern District of New York had approved the raid, which also needed clearance from a judge.
According to ABC News, current U.S. Attorney Geoffrey Berman recused himself from the Cohen raid decision carried out by his office.
Dershowitz said Robert Mueller likely knows he does not have the authority to call such a raid based on the parameters of the Russia investigation.
But, he said the U.S. Attorney's Office does.
"It seems like a subterfuge by which Mueller doesn't have the authority [so he] gives it to somebody else," Dershowitz said.

The CEO of New York state's oldest credit union swindled his institution for years out of millions of dollars and blew a whopping $3.55 million on lottery tickets, federal prosecutors charged Tuesday.
Kam Wong is accused of defrauding New York's Municipal Credit Union out of approximately $6 million with a series of scams that included reimbursements for fake dental work and a previously covered long-term disability insurance policy.
Wong was charged Tuesday in Manhattan federal court with fraud, embezzlement and aggravated identity theft offenses, according to Geoffrey Berman, the United States Attorney for the Southern District of New York.
Berman said Wong used the cash to, among other things, feed his apparent lottery habit, spending $3.55 million on the New York State lottery between July 2013 and January 2018.
During that same time frame, Wong allegedly received and deposited almost $6 million in hand-written checks from the credit union into his account.
From that account, Wong allegedly wrote more than 278 checks, totaling about $3.9 million.
He also is accused of writing checks totaling about $3 million to a convenience store in the Queens, New York, neighborhood of Elmont, and another $272,500 in checks to a convenience store located just a few blocks from his office.
Wong withdrew more than $1.9 million through about 2,592 ATM transactions over that same period, authorities said.
According to a criminal complaint, the convenience store owners said the checks were used to purchase New York State Lottery tickets, and that Wong would sometimes spend hours on weekends purchasing and playing lottery tickets at the Elmont location.
While defrauding and embezzling from the credit union, Wong also allegedly sought money from several sources to purchase lottery tickets.
"As alleged, the CEO and president of New York's oldest credit union abused his position of trust as a guardian of municipal, state, and federal workers' financial accounts to enrich himself," Berman said.
"Kam Wong allegedly stole money from the credit union's earnings that were intended to reward the credit union's members, not line Wong's pockets. I want to thank my Office's Special Agents for their dedicated efforts in this ongoing investigation."
The Municipal Credit Union, a federally insured nonprofit financial institution, is one of the largest credit unions in the country, with 425,000 members.
Its members include municipal, state and federal workers in New York City.
Wong, who was arrested Tuesday morning, was scheduled to appear before U.S. Magistrate Judge James Cott in Manhattan federal court later the same day.

There are a total of 93 U.S. Attorneys in the Department of Justice. As of 12 April 2018, 65 were nominated and 60 confirmed by the Senate. Last week, another three were confirmed (California, Central District; Hawaii; and Missouri, Western District) for a total of 63. In comparison to prior presidents, the number confirmed after 15 months in office: Reagan (71 after 1 year), Clinton (81), Bush (75), and Obama (51). Trump has done better than Obama but is underperforming the others.
Interim (with approval of district court) and acting US Attorneys can serve indefinitely until someone is approved by the Senate. Once confirmed, the person is limited to a four-year term. Some interim and acting appointees are nominated while others are not. Trump has not submitted nominees yet for the 28 districts below.
Interestingly, Rodriguez-Velez of Puerto Rico has been interim for over 10 years and Myers of North Dakota has been acting/interim for 3 years. Maybe there is something special about these two or the others listed causing the nomination submission slow roll. According to one article, eight of the top ten states with public corruption convictions are here. Sessions broke with long-standing tradition of appointing a Texan as head prosecutor for Nevada and a North Carolian as head prosecutor for U.S. Virgin Islands. Both of those have pretty bad crime problems.

I just found this article that says, "Under federal law, he will now serve until the Senate confirms a nominee by President Trump, whose administration has been slow to fill many posts in the executive and judicial branches."
So no term limit on him even until he is properly confirmed by Senate?
WELL PLAYED POTUS & Q!!!!
They are maintaining the APPEARANCE OF IMPARTIALITY as well FOR A REASON! I can't wait to see what that reason is!

Berman appears to be the only one that is skipping SENATE CONFIRMATION
WHY?
WHAT IS DIFFERENT ABOUT SDNY?
Berman, who was neither nominated by President Trump nor confirmed by the U.S. Senate, was set to see his term as an appointee end next week.
Geoffrey Berman, U.S. Attorney General Jeff Sessions' pick to be the U.S. attorney for the Southern District of New York, will remain in his position when his term as an appointee ends next week, court officials in the Southern District said Wednesday.

Trump-appointed US attorney recused from Michael Cohen investigation
The U.S. Attorney's office declined to comment.

Trump: FBI raid on Cohen 'a disgrace'
President Trump on Monday blasted the FBI for raiding the office of his personal attorney Michael Cohen, calling it a "disgrace" and a "pure and simple witch hunt."
"It's a real disgrace," Trump told reporters at the White House as Vice President Pence, national security adviser John Bolton and other officials looked on. "It's an attack on our country in a true sense. It's an attack on what we all stand for."
The president spoke shortly after an attorney for Cohen announced that federal investigators executed a series of search warrants to seize records from Trump's longtime lawyer and fixer.
The attorney, Stephen Ryan, said federal prosecutors in New York acted on a "referral" from special counsel Robert Mueller.
The fiery comments from Trump immediately led to speculation that the FBI raid on Cohen's office could lead Trump to take steps to fire Mueller, a step lawmakers in both parties have repeatedly warned the president would lead to a constitutional crisis.
"We'll see what happens. ... Many people have said 'you should fire him,' " Trump said when asked if he will ax Mueller. "Again, they found nothing and in finding nothing, that's a big statement."
The special counsel's office reportedly made the referral with the approval of Deputy Attorney General Rod Rosenstein, whom Trump criticized for signing a surveillance warrant for his former campaign adviser Carter Page.
If Trump were to try to get rid of Mueller, he would need a signoff from Rosenstein, who oversees the special counsel's office because of Attorney General Jeff Sessions's decision to recuse himself.
Trump once again took aim at the Russia probe led by Mueller, calling his team "the most biased group of people" for refusing to investigate 2016 Democratic presidential nominee Hillary Clinton over her use of a private email server during her time as secretary of State.
"We've had that hanging over us from the very, very beginning," the president said. "And yet the other side, they're not even looking. And the other side is where there are crimes, and those crimes are obvious."
The president was clearly angry and frustrated at the raid, which reportedly seized records on topics that included a $130,000 payment Cohen made to porn star Stormy Daniels, who says she had sex with Trump in 2006.
Trump said last week he was unaware of the payment.
Speaking with his arms folded and shoulders slumped, Trump brought up the raid unprompted during a previously scheduled meeting with military leaders to discuss the apparent chemical weapons attack in Syria. He used the word "disgrace" to describe it at least five times.
The raid is a sign that federal authorities are conducting a criminal investigation involving Cohen, but the focus of the probe remains unclear. The search warrant for the raid of Cohen's office was approved by the office of the U.S. Attorney for the Southern District of New York, which is led by Geoffrey Berman, a Trump appointee.
Watchdog groups have sued the Trump campaign alleging that the payment to Daniels, whose legal name is Stephanie Clifford, may have violated campaign finance laws.
Cohen has also come under scrutiny from investigators looking into whether the Trump campaign colluded with Russia's efforts to interfere in the 2016 election, in part due to his involvement with a failed plan by the Trump Organization to build a tower in Moscow.
Trump repeated his belief that investigators have "found no collusion whatsoever with Russia" and took aim at a wide array of targets he feels are responsible for the probe, including Sessions.
The president said Sessions "made what I consider to be a very terrible mistake for the country" by recusing himself from the Russia probe, a decision that helped lead to the appointment of Mueller.
Monday's raid underscored how the mounting legal woes surrounding Trump are weighing on the president.
Trump remarked that stocks plunged on Monday afternoon, something he blamed on the news of the Cohen raid. News of the Cohen raid broke 30 minutes after markets closed.
"The stock market dropped a lot today as soon as they heard the noise, you know, of this nonsense that was going on. It dropped a lot. It was up - it was way up. It dropped quite a bit at the end," he said.
The raid - and Trump's response to it - also overshadowed his plans to counter the chemical attack in Syria, which killed at least 40 people.
Trump said the attack will be "met forcefully" and indicated a decision will come Monday night.

So Trumps own pick turned on him?
Attorney General Jeff Sessions on Wednesday named Geoffrey Berman to succeed Preet Bharara as U.S. attorney for the Southern District of New York on an interim basis, 10 months after Trump fired Bharara in a purge of all federal prosecutors. The U.S. attorney in Manhattan is crucial because the district is home to Trump Tower, where a meeting between Trump campaign officials and Kremlin-linked Russians occurred in 2016.

The second important point is that our work on this case is critically important because it will disrupt the activities of the institute and it will do toward - deter similar crimes by other perpetrators. The indictment publicly identifies the conspirators. In this time of public identification, it helps to deter state-sponsored computer intrusions by stripping hackers of their anonymity and by imposing real consequences, revealing the mountain's institute nefarious activities makes it harder for them to do business. Additionally, we are working with foreign agencies in providing the private sector with information that would help neutralize the hacking infrastructure. By bringing these criminal charges we reinforce the norm that most of the civilized world accepts - nationstates should not steal intellectual property for the purpose of giving domestic industries a competitive advantage. As a result of the environment, the - indictment, these defendants are now fugitives from justice. There are more than 100 countries where they may face arrest and extradition to the united states. Thanks to the treasury department, the defendants will find it difficult to engage in business or financial transactions outside of i ran. By making clear the criminal actions have consequences, we deter schemes to victimize the united states, its companies, and its citizens, and we help to protect our foreign allies. In summary, the united states is taking several coordinated actions to coincide with unseal ing this indictment. We are imposing financial sanctions on the individual defendants. We are releasing information about cyber vulnerabilities, which will help private sector organizations perfect - protect themselves, and we are assisting international law enforcement partners. I am grateful to secretary steven mnuchin for using the treasury department's authorities to reinforce the charges are i also want to think Geoffrey Berman, john demurs, fbi director christopher wray, and the many employees, agents, and support personnel who worked to secure the support indictment. MR. Berman: THANK YOU, ROD. GOOD MORNING. MY NAME IS Geoffrey Berman, AND I'M BEEN AS STATE FOR THE SOUTHERN DISTRICT OF NEW YORK. TODAY, IN ONE OF THE LARGEST STATE-SPONSORED HACKING CAMPAIGNS EVER PROSECUTED BY THE DEPARTMENT OF JUSTICE, WE HAVE UNMASKED CRIMINALS NORMALLY WORK IN TOTAL ANONYMITY, HIDING BEHIND THE 1'S AND 0'S OF COMPUTER CODES. THIS MASSIVE AND BRAZEN CYBER ASSAULT ON SYSTEMS OF 144 U.S. UNIVERSITIES, 176 FOREIGN UNIVERSITIES IN 21 COUNTRIES, AND DOZENS OF GOVERNMENT ORGANIZATIONS AND PRIVATE COMPANIES. THIS ASSAULT WAS CONDUCTED ON BEHALF OF THE IRANIAN GOVERNMENT'S ISLAMIC REVOLUTIONARY GUARD, OR IRGC. AS THE INDICTMENT ALLEGES, THE DEFENDANTS WERE LEADERS OF THE INSTITUTE, AND IRANIAN COMPANY THAT CONDUCTED THE ASSAULT AT THE BEHEST OF THE IRG C AND SOLD THE LEGAL FRUITS OF THE HACKING. COMPANY WAS SET UP IN 2013 BY TWO DEFENDANTS. – WHILE THE COMPANY'S NAME MAY SOUND LEGITIMATE, THE SO-CALLED INSTITUTE WAS SET UP FOR ONE REASON ONLY – TO STEAL SCIENTIFIC RESOURCES FROM OTHER COUNTRIES AROUND THE WORLD. THE DEFENDANT'S GLOBAL CAMPAIGN OPERATED IN THREE PARTS – THE UNIVERSITY CAMPAIGN, PRIVATE COMPANY HACKS, AND NONGOVERNMENTAL ENTITY JHACKS. WITH RESPECT TO THE UNIVERSITY CAMPAIGN FROM 2013 TO 2017, THE DEFENDANTS TARGETED MORE THAN 100,000 ACCOUNTS OF UNIVERSITY PROFESSORS AROUND THE WORLD, AND BY TRACKING PROFESSORS – TRICKING PROFESSORS TO CLICK ON FALSE LINKS, COMPROMISED 8000 ACCOUNTS. ONCE THEY GAINED ACCESS, THE DEFENDANTS SOLD MASSIVE AMOUNTS OF ACADEMIC DATA AND INTELLECTUAL PROPERTY. UNIVERSITIES COMBINED HAD TO PAY $3.4 BILLION TO ACCESS THIS INFORMATION. THE DEFENDANTS GOT IT FOR FREE. THEY TARGETED DATA AND RESEARCH FROM ALL FIELDS, INCLUDING SCIENCE AND TECHNOLOGY,

I WANT TO MAKE TWO ADDITIONAL POINTS BEFORE I TURN THE MICROPHONE OVER TO UNITED STATES ATTORNEY JEFFREY Berman, WHO WILL PROVIDE MORE DETAILS ABOUT THE ALLEGATIONS AND THE DEFENDANTS. FIRST, EVERY SECTOR OF OUR ECONOMY IS THE TARGET OF MALICIOUS CYBER ATTACKS. EVERYONE THAT OWNS A COMPUTER NEEDS TO BE VIGILANT TO PREVENT ATTACKS. ACADEMIC INSTITUTIONS ARE PRIME TARGETS FOR FOREIGN CYBER COMMANDS. UNIVERSITIES CAN THRIVE AS MARKETPLACES OF IDEAS AND ENGINES OF RESEARCH AND DEVELOPMENT ONLY IF THEIR WORK IS PROTECTED FROM THEFT. THE EVENTS DESCRIBED IN THIS INDICTMENT HIGHLIGHT THE NEED FOR UNIVERSITIES AND ALL OTHER ORGANIZATIONS TO EMPHASIZE CYBER SECURITY, INCREASED THREAT AWARENESS, AND HARDEN COMPUTER NETWORKS. THE SECOND IMPORTANT POINT IS THAT OUR WORK ON THIS CASE IS CRITICALLY IMPORTANT BECAUSE IT WILL DISRUPT THE ACTIVITIES OF THE INSTITUTE AND IT WILL DO TOWARD – DETER SIMILAR CRIMES BY OTHER PERPETRATORS. BY BRINGING THESE CRIMINAL CHARGES WE REINFORCE THE NORM THAT MOST OF THE CIVILIZED WORLD ACCEPTS – NATIONSTATES SHOULD NOT STEAL INTELLECTUAL PROPERTY FOR THE PURPOSE OF GIVING DOMESTIC INDUSTRIES A COMPETITIVE ADVANTAGE. AS A RESULT OF THE ENVIRONMENT, THE – INDICTMENT, THESE DEFENDANTS ARE NOW FUGITIVES FROM JUSTICE. WE ARE RELEASING INFORMATION ABOUT CYBER VULNERABILITIES, WHICH WILL HELP PRIVATE SECTOR ORGANIZATIONS PERFECT – PROTECT THEMSELVES, AND WE ARE ASSISTING INTERNATIONAL LAW ENFORCEMENT PARTNERS. Answer: JUST THE NEWS: Fired NY prosecutor was given Biden-Ukraine allegations in 2018 but didn’t follow up, emails show Ukraine prosecutors didn't want the political spectacle that became impeachment and simply sought to turn over evidence about Joe Biden and election interference to U.S. prosecutors, memos show. By John Solomon | Last Updated: June 22, 2020 - 11:30pm https://archive.fo/uj3h7 Could the impeachment scandal have been prevented if the now-fired U.S. Attorney Geoffrey Berman had followed up on Ukrainian allegations about Joe Biden and his family in 2018? That’s the tantalizing question raised by emails from fall 2018 between an American lawyer and the chief federal prosecutor in Manhattan that were obtained by Just the News. The memos show that well before Ukrainian prosecutors reached out to Rudy Giuliani, President Trump’s lawyer, in 2019 to talk about the Bidens and alleged 2016 election interference they first approached Berman’s office in New York in October 2018 via another American lawyer.
