The Washington Post has reported that Obama holdover and donor David Laufman, a DOJ official who overlooked the Clinton email probe has stepped down.
Laufman was responsible for sitting in on interviews with Hillary aides including Cheryl Mills, Huma Abedin and Jake Sullivan.
He has been accused of leaks and many will question the timing of his resignation given the shocking revelations of bias and weaponization of the FBI and DOJ in the Strzok-Page texts and FISA memo.
Laufman became a target of the far-right blogosphere, with conspiracy theorist Mike Cernovich accusing him last year of being the source of "national security leaks." Number 3 official at Justice Department suddenly resigns

What the hell is going on at the Justice Department? Yesterday, Editor Lifson wrote about the resignation/firing of two high ranking officials at the FBI and the Department of Justice. Both had played a role in the Clinton investigation. Both resigned suddenly.

Lifson linked to a piece at the Conservative Treehouse that listed other recent resignations:

"Mike[,]" aka Michael Kortan (FBI [a]sst. [d]irector [p]ublic [a]ffairs)[,] quits today.
"Dave[,]" aka David Laufman (DOJ - National Security Division, [d]eputy [a]sst. [a]ttorney [g]eneral in charge of counterintelligence)[,] quit yesterday.
"Trisha[,]" aka Trish Beth Anderson (Office of Legal Counsel, FBI)[.]

Not listed was the firing of FBI Deputy Director Andrew McCabe who will figure prominently in the IG investigation into the bureau's handling of Clinton's email investigation.

Another shoe dropped yesterday. The third ranking official at the Department of Justice, Rachel Brand, suddenly resigned to take a "dream job" as an WalMart executive. What makes her resignation even more curious is that Brand was next in line to oversee the Mueller investigation, behind Rod Rosenstein. Rosenstein is thought to be in big trouble and could be fired by Trump or resign in the near future.

Fox News:

DOJ officials say Principal Deputy Associate AG Jesse Panuccio will step in as the acting Associate Attorney General.

News of Brand's departure was first reported by The New York Times.

In the line of succession, Brand had been behind Deputy Attorney General Rod Rosenstein. Rosenstein is overseeing Special Counsel Robert Mueller's probe into Russian interference in the 2016 presidential election. She was in line to oversee the investigation if Rosenstein stepped down.

Should Rosenstein step down now, Solicitor General Noel Francisco would take over the probe, not Panuccio. (Attorney General Jeff Sessions recused himself from the Russia inquiry last year.)

Her resignation could be entirely coincidental. People in DC get offered plum jobs all the time. But this seems to throw "coincidence" into a cocked hat:

Brand had been overseeing the DOJ's antitrust, civil and civil rights divisons. She also assisted in an extension of the National Security Agency's warrantless surveillance program. (Emphasis mine).

That program is not directly related to the FISA warrant program. The NSA warrantless surveillance program is supposed to spy on foreigners, with Americans sometimes getting caught up in its investigations if they communicate with people overseas who are being surveilled. If Americans are incidentally caught up in the NSA surveillance program, the only way to discover their identities is to "unmask" them.

National Review:

So, as noted in coverage of the Obama administration's monitoring of Trump-campaign officials, FISA section 702 provides some privacy protection for Americans: The FISA court orders "minimization" procedures, which require any incidentally intercepted American's identity to be "masked." That is, the NSA must sanitize the raw data by concealing the identity of the American. Only the "masked" version of the communication is provided to other U.S. intelligence agencies for purposes of generating reports and analyses. As I have previously explained, however, this system relies on the good faith of government officials in respecting privacy: There are gaping loopholes that permit American identities to be unmasked if, for example, the NSA or some other intelligence official decides doing so is necessary to understand the intelligence value of the communication.

And Brand "assisted" in this program. Mmmmmm…

The spate of firings and resignations may or may not be unprecedented. Certainly in recent memory it is. But the massive incuriousness of the press about what's happening at DoJ rasies the question: Is there any information that threatens or contradicts their narrative about Trump and Russia collusion ever going to be reported?

Inspector General Horowitz Submits Draft Report of Clinton Email Investigation For Principal Review

More Key Points:

?FIRST, the draft report is reviewed internally. Only the principal officers who are currently inside the investigated agency get to see it. Those officials must sign comprehensive Non Disclosure Agreements, subject to criminal prosecution if they violate the NDA.

Former Officials, or employees who have left the agency: ex. James Comey, Andrew McCabe, Lisa Page, James Baker, Jim Rybicki, Michael Kortan and all of the officials who have left the FBI will not get to see the draft report. [Now you know why Lisa Page and James Baker were dispatched last week.]

The same IG rules of Draft Report distribution apply on the Main Justice side of the DOJ and (DOJ-NSD) (DOJ-National Security Division). Loretta Lynch, Sally Yates, Mary McCord, David Laufman, etc. do not get to see the report. Attorney General Jeff Sessions and Asst. AG Rod Rosenstein will review the draft report and control who they allow to review.

On the FBI side, Director Christopher Wray will review the draft report along with Asst FBI Director David Bowditch (if approved). Likely FBI Chief Legal Counsel Dana Boente, the former head of the DOJ-NSD, will also review. [*note* now you know why Boente was brought back inside in January '18] Two more principals who could review would be FBI Asst. Director in charge of Counterintelligence Bill Priestap; and we must remember - FBI Agent Peter Strzok was not kicked out, he also remains inside.

? SECONDLY, the IG report does not include criminal referrals. The final IG report is a statement of facts. The IG report only provides the facts to decision-making leadership, who then decide what to do with those facts. However, if the IG discovers evidence of unlawful or illegal activity during the course of his/her investigation, the IG has a legal and ethical responsibility to tell the head of the DOJ immediately.

The IG cannot keep evidence of unlawful conduct hidden until the release of the report.

This is important because Attorney General Jeff Sessions appointed U.S. Attorney John Huber to join IG Horowitz toward the end of last year (2017).

The federal attorney (Huber) then constructs a parallel investigation based on the evidence the IG has discovered.

However, as with all criminal investigations, Prosecutor John Huber would then fire-wall the IG from his own expanded criminal investigative inquiry.

It is critical to understand what happens when a U.S. Attorney joins with the OIG. The evidence flow only goes one-way. The IG is not participating in a criminal investigation. The IG is only looking at facts within his investigation and shares any pertinent investigative findings with the U.S. Attorney. The U.S. attorney does not provide the IG with findings from his criminal investigation.

IG Horowitz and U.S Attorney Huber might interview the same subjects. [In rare instances they might even interview the same subject simultaneously] However, Huber would not share his criminal investigative interview content/evidence with Horowitz. Therefore the content of a final IG report may contain outlines/evidence of criminal behavior, but there could be -likely is- much more evidence in addition to the IG report.

How the criminal prosecutions might proceed after the final IG report is released involves prosecutor strategy.

U.S. Attorney John Huber may wish to wait and see how the participants react to the facts outlined in the report; or he may use the IG report to expand his criminal investigation and conduct additional interviews of people who are outside government, and as a consequence outside of the IG investigative reach.

Huber may -likely does- already have this process, and a seated grand jury, well underway.

We now know Attorney General Jeff Sessions and DAG Rod Rosenstein assigned federal prosecutor John W. Huber to that task. However, even without knowing his name, we always knew the existence of the parallel prosecutor because the fingerprints of his tasks were evident.

The IG couldn't simultaneously report on his discovery of criminal conduct and yet construct the parameters for cooperation and compliance with his investigation. IG Horowitz doesn't have that authority, that's a federal prosecutors job.

So if people within the FBI and DOJ were cooperating with an internal investigation that was discovering criminal conduct, someone from within the DOJ had to be cutting the deals. Jeff Sessions told us yesterday that person is John Huber.

As a person familiar with such specific investigative measures shared:

"They are sat down, told to not do anything, say anything or discuss anything UNTIL they get an attorney. At which time, the attorney is handed a letter from the investigating unit. That letter says in essence, this is how screwed you are. If you want to be less screwed you will sign this letter of cooperation and assist us. When we don't need you, you sit there. When we do we will call you and you will provide what we need. Any deviation from this agreement lands you in jail for the full term."

If you stand back and look at all activity from July 2017 through March 2018 you can get a good feel for who is inside the "small group", who is cooperating and who is not.

AG Sessions, while responding to an irrelevant congressional request for a special counsel, told us yesterday that Huber is in charge of a "team" of prosecutors. Yet some weird and seemingly illogical reason, many people don't seem to understand that.

There's already a team of prosecutors reviewing all the evidence of criminality collected by Inspector General Horowitz.

There was a very telling interview with House Intelligence Member Chris Stewart on Judge Jeanine last night.

At 2:33 a simple question was asked:

PIRRO: Have you heard the name Bill Priestap - in the FBI - who's Head of Counterintelligence and Strzok's boss.

STEWART: Yeah. We've heard that name and you're gonna hear more of that name.

At 3:16

PIRRO: I want to go back to Priestap. I want my audience to remember this name. Bill Priestap. I don't like that I haven't heard of him. We've heard of the whole hierarchy - everybody on that 7th floor. There's one guy we don't hear about - Priestap.

PIRRO: Comey threw him under the bus and said that this guy, who's Strzok's boss, told Comey not to advise Congress of certain things. The fact that we haven't heard from Priestap tells me he's cooperating with someone or - what?

STEWART: Well look, I'm gonna be careful on this. I'm not sure what we can say on this. And believe me, I don't want to be the headline "Chris Stewart reveals a bunch of sensitive or classified information".

Stewart quickly moved into a generalized discussion of the politicization of the FBI.

Individuals directly below Priestap (Strzok) and directly above Priestap (McCabe) have been ensnared and exposed by the Inspector General's Investigation:

Comey has been fired.
Strzok is off Mueller's team and has been demoted. He is on the verge of being subpoenaed by Congress.
Bruce Ohr has been demoted - twice.
McCabe was recently forced to resign. McCabe is also on the verge of being subpoenaed by Congress.
FBI top counsel James Baker was effectively fired in January.
Associate Attorney General Rachel Brand - the number three official behind Deputy AG Rosenstein - quit two days ago.
Michael Kortan - FBI Asst. Director Public Affairs - quit three days ago.
David Laufman - DOJ National Security Division, Deputy Asst. Attorney General in charge of counterintelligence - quit four days ago.
So where is Bill Priestap?

And why aren't you hearing his name daily?

Because someone has almost certainly been speaking with him.

There have been two earlier indications that Priestap has flipped and is cooperating with ongoing investigations by the Inspector General and Congress.

Representative Chris Stewart's reaction was the final confirmation.

It is now virtually certain.

Bill Priestap is a cooperating witness. And Bill Priestap knows - quite literally - everything.

The FBI's media chief and the head of the Justice Department's anti-espionage section are both departing.

Two more senior government officials who were prominently discussed in text messages exchanged by FBI personnel formerly assigned to the Trump-Russia investigation are leaving their positions.

Mike Kortan, FBI assistant director for public affairs, is set to retire next week, an FBI spokeswoman confirmed. In addition, the chief of the Justice Department's Counterintelligence and Export Control Section, David Laufman, resigned this week, a department spokesman said.

Both men are discussed in text messages sent by senior FBI Agent Peter Strzok and FBI attorney Lisa Page. President Donald Trump and many Republican lawmakers have argued that the texts are evidence of anti-Trump bias at senior levels of the Justice Department and FBI.

While the texts contain derogatory mentions of Trump, the messages made public thus far don't attribute that sentiment to Kortan or Laufman, and there's no indication that either departure is related to the recent flap.
